ORDER

The petitioner aggrieved by the inaction of the respondent No.2, Regional Passport Officer, in correcting the year of birth in the petitioner’s passport bearing No.J5048759 as the correct year of birth is 1935 instead of wrongly entered as 1941, filed the present writ petition.

2. The learned counsel for the petitioner would submit that the petitioner is aged about 90 years and her family members have settled in USA holding green card. Petitioner is suffering from her old age ailments and also suffering from dementia. Since the petitioner wanted to join her family members at USA and her passport bearing No.J5048759 is already expired she approached the respondent No.2 for renewal of passport, and the respondent No.2, after scrutinizing the passport and other documents, did not accept her application as her date of birth in the passport is reflecting the year of birth as 1941 whereas in all other documents such as PAN card and Aadhar card etc., are showing her year of birth as 1935. Since the pending order has been passed thereon, petitioner filed the present writ petition.
