JUDGMENT:

This appeal is filed by TSRTC, aggrieved by the Order and Decree dated 08.10.2020 in M.V.O.P.No.121 of 2017 passed by the Chairman, Motor Accident Claims Tribunal-cum-Spl. Judge for trial of Cases Under SCs/STs (POA) Act-Cum-V Additional District and Sessions Judge, Adilabad (for short “the Tribunal”).

2. For convenience and clarity, the parties herein are referred to as they were arrayed before the Tribunal.

3. The case of the petitioner before the Tribunal is that on 29.05.2015 at about 14:00 hours, while the petitioner was proceeding on motor bike as pillion rider bearing No.AP-01N-4692 belonging to Nelko Pithamber from Mancherial to Luxettipet on the extreme left side margin, when they reached near Ankathapally, the driver of RTC Bus bearing No.AP-10Z-6194 has suddenly stopped the bus without giving any indication, due to which the rider of the motor bike dashed the RTC bus from behind, as a result, the petitioner along with the rider of the motor bike, fell down and sustained fracture injuries.
