ORDER:

Heard Sri Ramesh Chilla, learned counsel appearing on behalf of the petitioner and learned Assistant Government Pleader for Services-I appearing on behalf of the respondents.

2. The petitioner approached the Court seeking prayer as under:

“…to issue an appropriate Writ, Order or direction more particularly on in the nature of Writ of Mandamus, declaring the inaction of the 2nd Respondent in considering the genuine caste certificate of the petitioner even after inquiry reports submitted by 6th Respondent - RDO and 7th Respondents - Tahsidar and as a result continuing in Assistant Beat Officer by denying her Promotion as Forest Beat Officer since 2012 is illegal, arbitrary, discriminatory, unfair, unreasonable, unjust, unconstitutional, unlawful, inequity and in violation of Principles of Natural Justice and in violation of Articles 14, 16, 19 and 21 of the Constitution of India and consequently direct the 2nd Respondent to consider the petitioners ST Certificate as genuine based on the reports submitted by Tahsildar and RDO and promote her to Forest Beat Officer with effect from October, 2012 on par with other Assistant Beat Officer with all consequential benefits and to pass…”

3. The case of the petitioner in brief as per the averments made in the affidavit filed by the petitioner in support of the present Writ Petition is as under:-

The respondents are not considering the genuine caste certificate of the petitioner even after inquiry reports had been submitted by the 6^th and 7^th respondent thereby denying the petitioner ‘s right to promotion to the post of Forest Beat Officer, since 2012 is illegal and arbitrary. Aggrieved by the action of the respondents, the Writ Petition is filed.

4. PERUSED THE RECORD.

A. The relevant portion of the letter, Rc.No.5271/ 2012/ S1, dated 29.07.2025 addressed by the District Forest Officer, Mulugu District to the Government Pleader for Forests, High Court of Telangana is extracted hereunder:-

In view of the above serious position in the case, and to implement the Hon’ble APAT orders issued in OA No.2691 of 2013 and to submit the compliance report to the APAT, Hyderabad in O.A.No.2691 of 2013 filed by Smt.Ravishetti Jyothi Rani, A.B.O., the PO-ITDA, Eturnagaram was requested to arrange to communicate necessary orders in the case, regarding verification of ST local schedule area certificate of Smt. R.Jyothi Rani, A.B.O. urgently, without any further loss of time. Due to this pendency report from the PO, ITDA Eturnagaram (8^th respondent), Smt. R.Jyothi Rani, ABO, was not still promoted to the post of Forest Beat Officer, w.e.f.2012, with all consequential benefits on par with other ABOs appointed in the same batch.

DI SCUSSI ON AND CONCLUSI ON:-

Learned Assistant Government Pleader for Services-I appearing on behalf of the respondents brings on record, letter Rc.No.5271/ 2012/ S1, dated 29.07.2025 addressed by the District Forest Officer, Mulugu District to the Government Pleader for Forests, High Court of Telangana. 6. Learned Assistant Government Pleader for Services-I appearing on behalf of the respondents submits that in view of the pendency of the report from the Project Officer, I TDA, Eturunagaram i.e., 8^th respondent herein pertaining to the verification of ST local Schedule Area Certificate of the petitioner, the petitioner could not be promoted to the post of Forest Beat Officer w.e.f. October, 2012 with all consequential benefits on par with other Assistant Beat Officers appointed in the same batch, therefore, appropriate orders may be passed, directing the Project Officer, I TDA, Eturunagaram/ 8^th respondent herein to forward the report/ certificate pertaining to the ST local schedule area certificate of the petitioner herein and upon the receipt of the said report form the Project Officer, I TDA, Eturunagaram/ 8^th respondent, appropriate orders would be passed by the respondent Nos.2 to 5 herein, duly consideri
