ORAL ORDER

Heard Mr. Y. Shashidhar Reddy, learned counsel for the petitioners and Mr. B. Sridhar, learned Assistant Government Pleader for Home appearing on behalf of respondent Nos.1 to 5.

2. This writ petition is filed challenging the action of respondent No.5 in calling the petitioners to the police station and harassing them without following due procedure laid down under law.

Whereas, learned Assistant Government Pleader for Home, on instructions, would submit that petitioner No.1 has filed a complaint under Section - 200 of Cr.P.C. and the same referred to Jadcherla Police Station, who in turn registered a case in Crime No.495 of 2015 for the offences punishable under Sections - 420, 465, 568, 469 and 471 of IPC. The Investigating Officer has not completed investigation in the said crime in accordance with law. The Public Information Officer/Inspector of Police of Jadcherla Police Station has furnished information to the petitioner dated 19.11.2021 stating that the said crime was referred as mistake of fact on 29.05.2019 erroneously. The said information furnished by the Public Information Officer of Jadcherla Police Station is factually incorrect.

Since the Investigating Officer in the said crime has not completed investigation fairly and kept intact, the Superintendent of Police, Mahabubnagar District, issued charge sheet to the then Investigating Officer in the subject crime, Mr. G. Balraju, presently working as Inspector of Police, RGI Police Station, Shamshabad. He has also appointed Mr. Kamalakar, Inspector of Police, as Investigating Officer in the said crime. He has completed investigation and he is going to file charge sheet shortly. For the purpose of investigation, he has called the petitioner and he never harassed the petitioner as alleged in the writ affidavit. The copies of said letter, memorandum of charge and statement of imputation are placed on record.

In the light of the above submissions, this writ petition is disposed of directing the Investigating Officer in Crime No.495 of 2015 of Jadcherla Police Station to complete investigation and lay charge sheet. He shall not harass the petitioners under the guise of investigation. However, if any further inforamationis required from the petitioners, he can seek from them and the petitioners shall co- operate with the Investigating Officer by furnishing information as sought by him. In the circumstances of the case, there shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
