ORDER:
Heard learned counsel for petitioner and learned Assistant Government Pleader for Prohibition & Excise appearing for respondents.
2. According to the petitioner, he is the absolute owner of an Auto Rickshaw bearing registration No.TS-04-UD 1766. In proof of the same, he has filed a copy of the registration certificate. According to him, on the allegation that he is illegally transporting the I.D. liquor, the said vehicle was seized by 3rd respondent in connection with COR No.161 of 2025 dated 03.04.2025 of Thorrur Prohibition & Excise Station, Mahabubabad District, for the offence punishable under Section 7A read with Section 8(e) of the Telangana Prohibition Act, 1995 (for short ‘the Act, 1995’). The subject vehicle is kept at 3rd respondent Police Station and it is exposed to Sun and rain, in which event, the petitioner will be put to severe loss and hardship. Therefore, he is seeking a direction to respondent Nos.2 and 3 to release the subject vehicle.
