THE HON’BLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No. 8995 of 2025

ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short ‘BNSS’) seeking anticipatory bail to the petitioner/accused No.7 in Crime No.81 of 2024 on the file of the Shahalibanda Police Station, Hyderabad, for the offences punishable under Sections 302 and 307 r/w 34 of the Indian Penal Code, 1860 (for short ‘IPC’).

2. When this criminal petition is taken up for hearing on 25.07.2025 there was no representation on behalf of the petitioner either physical mode or virtual mode. To give one more opportunity, the matter was posted to 29.07.2025. However, today also, there is no representation on behalf of the petitioner, either in physical mode or virtual mode. It appears that the learned counsel for the petitioner is not interested to prosecute the matter. Hence, this Court is not having any option except to proceed with the matter on merits.

3. Heard Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor for respondent No.1 -State.

Learned Additional Public Prosecutor submitted that the petitioner has committed a grave offence and there are specific allegations levelled against the petitioner to attract the ingredients of the alleged offences. He further submitted that the investigating officer after conducting investigation filed charge sheet before the learned XVI Additional Chief Metropolitan Magistrate, Nampally and the same was numbered as P.R.C.No.143 of 2025 and the petitioner is not entitled for grant of anticipatory bail.

Having considered the rival submissions made by the learned Additional Public Prosecutor and after perusal of the material available on record, it reveals that there are specific overt acts attributed to the petitioner that he along with the other accused, committed the murder of the deceased, which attracts the ingredients of Section 302 IPC. The record further reveals that the investigating officer after conducting investigation filed charge sheet before the learned XVI Additional Chief Metropolitan Magistrate, Nampally and the same was numbered as P.R.C.No.143 of 2025.

6. Taking into consideration the facts and circumstances of the case and the gravity and seriousness of the offence, this Court is of the considered view that it is not a fit case to grant anticipatory bail to the petitioner/accused No.7.

7. Accordingly, this Criminal Petition is dismissed.

Miscellaneous applications, pending if any, shall stand closed.
