WP 19683/2025

THE HON’BLE SRI JUSTICE NAMAVARAPU RAJESHWAR RAO WRIT PETITION No.19683 of 2025

ORDER

The present Writ Petition is filed to declare the action of the respondents in not issuing the appointment order to the petitioner for the post of Secondary Grade Teacher (Telugu Medium), despite his eligibility as illegal.

2. Heard Sri Ramesh Chilla, learned counsel for the petitioner and learned Government Pleader for Services-I appearing for respondents.

3. Learned counsel for the petitioner submits that the petitioner belongs to Scheduled Tribe (ST) community and is eligible for the post of Secondary Grade Teacher(SGT) in Telugu Medium as per the relevant DSC Notification. Petitioner appeared for the said recruitment process and secured 48.43 marks, attaining the rank of 1511 under Hall Ticket No. 246252269492 and he was also included in the 1:3 selection list issued by the respondents.

4. Learned counsel for the petitioner further submits that despite petitioner got the message that he had been provisionally selected for the post of SGT Telugu in Hyderabad District, appointment orders were not given to him. Upon enquiry with the office of the third respondent, i.e., the District Educational Officer, Hyderabad, the petitioner was informed that his candidature was kept pending due to a doubt concerning his local/nativity status, as he completed his primary education in Hyderabad and upper primary and high school education in Nagar Kurnool district.

5. Learned counsel for the petitioner further submits that subsequently, an enquiry was also conducted regarding petitioner’s nativity/local status, and no adverse material was found against him. The petitioner had submitted representations dated 18.10.2024 and 12.03.2025 respectively to the 3rd respondent, i.e., the District Educational Officer, Hyderabad, clearly stating that he was included in the merit list for the SGT Telugu Medium post and that he possesses all valid and genuine educational records confirming his eligibility and nativity status. But, till date, the respondent authorities neither disposed of his representations nor rejected his applications. Accordingly, prayed to direct the respondent authorities to consider the representation of the petitioner, dated 12.03.2025 and pass appropriate orders.

6. Learned Government Pleader for the respondents submits that for disposal of the petitioner’s representation dated

12.03.2025, they do not have any objection.

7. Having regard to the submissions made by the learned counsel for respective parties, this Court, without expressing any opinion on the merits of the case, direct the respondent authorities to consider the petitioner’s representation, dated 12.03.2025 and pass appropriate orders, in accordance with law, within a period of six (06) weeks from the date of receipt of a copy of this order.

8. With the above direction, this Writ Petition is disposed of.

There shall be no order as to costs.

Miscellaneous applications, if any pending, shall also stand closed.
