ORDER:
This Contempt Case is filed alleging willful and deliberate violation of order dated 04.11.2024 passed by this Court in Writ Petition No.25934 of 2024.
2. Vide aforesaid order, this Court disposed of the said Writ Petition directing the Deputy Commissioner, Circle 23, Moosapet, Greater Hyderabad Municipal Corporation (GHMC), to take further steps pursuant to speaking order dated 16.04.2024.
3. Petitioner filed the present Contempt Case against the respondent, who is working as Zonal Commissioner, Circle No.23, Moosapet, GHMC, Kukatpally, Hyderabad, alleging willful and deliberate violation of the aforesaid order dated
04.11.2024.
4. It is relevant to note that vide order under contempt, this Court had directed the Deputy Commissioner, Circle 23, Moosapet, GHMC, but not the respondent herein. Therefore, if the petitioners are aggrieved, they have to file a Contempt Case against the said Deputy Commissioner but not against the respondent herein, who is working as Zonal Commissioner.
5. Sri K. Ravi Mahender, learned Standing Counsel for GHMC, on instructions, would submit that the Deputy Commissioner, Circle 23, Moosapet, GHMC, has already passed a speaking order dated 24.03.2025 in compliance with the order under contempt. Challenging the said speaking order dated 24.03.2025, 8th respondent in the subject Writ Petition and others have filed Writ Petition No.9729 of 2025 against the official respondents including the Deputy Commissioner and the petitioners in Writ Petition No.25934 of 2024. In the said Writ Petition No.9729 of 2025, vide interim order dated 28.03.2025, this Court directed the aforesaid Deputy Commissioner not to take any coercive steps pursuant to the order dated 24.03.2025 impugned therein till the next date of hearing.
6. In the light of the above, this Contempt Case is closed. However, if the petitioners are aggrieved by the order under contempt, they are at liberty to file a Contempt Case against the Deputy Commissioner, Circle 23, Moosapet, GHMC, if so advised.
