ORDER

Heard learned counsel for the petitioners and Learned Assistant Government Pleader for Roads and Buildings appearing for respondent Nos.1, 3 and 4 and Sri.H.Rakesh Kumar, learned Assistant Government Pleader for Revenue appearing for respondent No.2. With their consent this writ petition is taken up for disposal.

2. This writ petition is filed seeking the following prayer:-

“to declare the action of the respondents in laying the road in the middle of the Petitioners in Sy.No.38 an extent of Ac. 12-00 situated at Vayi Village, Kubeer Mandal, Nirmal District, (Adilabad) is illegal, arbitrary, unconstitutional and violation of Principles of Natural Justice and contrary to the provisions of Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 and as well as the fundamental rights guaranteed under the constitution of India and consequently direct the respondents not to lay the road in the petitioners above lands.”

3. Brief facts stated in this writ petition are that the petitioners claims to be the owners and possessors of land admeasuring to an extent of Ac.12.0
