ORDER
Heard Sri C.Ramachandra Raju, learned counsel for the petitioner; the learned Government Pleader for Home and the learned Assistant Government Pleader for School Education, for respondent Nos.1, 4 and 5 respectively.

The petitioner herein has submitted a representation dated 08.04.2025 to the 3rd respondent stating that the 7th respondent-petrol bunk is adjacent to the 6th respondent- School and the same is in violation of guidelines issued by Control Pollution Control Board, New Delhi, in Office Memorandum No.B-13011/1/2019-20/AQM, dated 07.01.2020. Therefore, he has requested the 3rd respondent to remove the 7th respondent-petrol bunk, which is adjacent to the 6th respondent school. On receipt of the said representation, the 2nd respondent transferred the said Even then, the 5th respondent has taken any action. Therefore, aggrieved by the said inaction of the 5th respondent, the petitioner filed the present writ petition.

Learned Government Pleader for Home, on instructions, submits that the 7th respondent-petrol bunk was established first and thereafter, the 6th respondent-school was started in the said premises situated at Huzurabad, Karimnagar. However, the 5th respondent will examine the representation dated 08.04.2025 submitted by the petitioner herein and take action strictly, in accordance with law, by putting the petitioner and the 6th and the 7th respondent on notice and affording them an opportunity.
4. Learned Assistant Government Pleader for Revenue has produced G.O.Ms.No.56, Home (Services.IV) Department, dated 26.07.2019, to contend that the 6th respondent-school cannot run school within 50 meters from 7th respondent-
petrol bunk.

In the light of the said submission, this Writ Petition is disposed of directing the 5th respondent to examine the representation dated 08.04.2025 submitted by the petitioner dated 19.05.2025, and take action, in accordance with law, within two months from the date of receipt of a copy of this order, by putting the petitioner and the 6th and the 7th respondent on notice and affording them with an opportunity. The 3rd respondent shall consider the aforesaid G.O. and guidelines issued by Control Pollution Control Board in Office Memorandum No.B-13011/1/2019-20/AQM, dated 07.01.2020, and he shall also consider the fact that the petrol bunk was established first and permission was granted to the school thereafter, while disposing the representation dated 08.04.2025. Miscellaneous petitions pending, if any, shall stand closed.
