ORAL ORDER:

Heard learned counsel for the petitioner and Mr.L.Ravinder, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 6.

Petitioner herein is claiming that he is the absolute owner and possessor of land admeasuring Ac.0.09 guntas in Sy.No.81/1అ, Ac.0.08 guntas in Sy.No.81/2అ, Ac.0.07 guntas in Sy.No.81/3అ, Ac.0.04 guntas in Sy.No.81/4/అ, Ac.0.04 guntas in Sy.No.81/4/ఆ1, Ac.0.04 guntas in Sy.No.81/4/ఇ/1, Ac.0.04 guntas in Sy.No.81/4/ఈ/1, Ac.0.15 guntas in Sy.No.81/6అ/1, Ac.0.05 guntas in Sy.No.81/6ఆ/1, Ac.0.02 guntas in Sy.No.81/ఈ/1 and Ac.0.20 guntas in Sy.No.82/ఆ/1/1/1/2, in total Acs.2.02 guntas, situated at Sitarampally Village, Wargal Mandal, Siddipet District. In proof of the same, he has filed the copy of latest pattadar passbook-cum-title deed. He has submitted F-Line applications bearing Nos.DER022501138356, dated 10.02.2025 with respondent No.5 with a request to conduct survey and demarcate the subject property by fixing the boundaries. Respondent No.5 entrusted the survey to respondent No.6, who in turn, issued notice dated 03.05.2025 fixing the date of survey on 08.05.2025.

According to the learned counsel for the petitioner, respondent No.6 did not conduct survey on 08.05.2025 and requested the petitioner to submit fresh F-Line application in terms of the Telangana Bhu Bharati (Record of Rights in Land) Act, 2025 (for short ‘Act, 2025’) and the Telangana Bhu Bharati (Record of Rights in Land) Rules, 2025 (for short ‘Rules, 2025’) were also framed vide G.O.Ms.No.39, Revenue (Land Administration–I) Department, dated 14.04.2025. Accordingly, petitioner submitted fresh F-Line application bearing No.DER022501202039, dated 05.07.2025, under the Rules, 2025. Despite receiving and acknowledging the said application, respondent No.5 did not act upon the same.

Aggrieved by the said inaction of respondent No.5, petitioner filed the present writ petition.

4. Whereas, learned Assistant Government Pleader for Revenue, on instructions, would submit that respondent No.5 will consider the said F-Line application, dated 05.07.2025 and conduct survey, strictly in accordance with law.

In the light of the said submissions, this Writ Petition is disposed of directing respondent No.5 to consider the said F- Line application, dated 05.07.2025 submitted by the petitioner with a request to conduct survey and demarcate the subject property by fixing boundaries, strictly in accordance with law, by putting the petitioner and all interested parties on notice and affording them an opportunity. If respondent No.5 is not inclined to accept the request made by the petitioner, he shall assign specific reasons, pass a reasoned order and communicate the copy of the same to the petitioner. He shall complete the entire exercise within forty-five (45) days from the date of receipt of a copy of this order.

Miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
