THE HONOURABLE SRI JUSTICE NAGESH BHEEMAPAKA WRIT PETITION No.20755 of 2025

ORDER:

Heard learned counsel appearing for the petitioners and learned Government Pleader for Social Welfare appearing for respondent Nos.1 to 4.

2. This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“….to issue writ or direction preferably writ of mandamus declaring the inaction on the part of the respondent No.1 herein in registering the revision and the interlocutory application seeking stay dated 23.06.2025 on the orders passed by the respondent No.2 in CMA No.63/2024 dated 30.05.2025 as illegal, arbitrary and violative of principles of natural justice article 300A of the constitution of India and consequentially direct respondents Nos.1 to 4 and their subordinate staff not to dispossess the petitioners from the possession and enjoyment of the house in the schedule property i.e.H.No.7-1-328 in an extent of 260 Sq yards in Sy.No.138/1600 in Manuguru (V & M) pending disposal of the revision on the file of the respondent No.1 herein…”

Brief facts of the case are that petitioners are owners of the land to an extent of 260 square yards, which was purchased by the father of petitioner No.2 under sada sale deed dated 11.06.1967 and later constructed house bearing H.No.7-1-328. It is stated that at the instance of respondent No.5, respondent No.3 had initiated the LTR case vide No. 35/2023/MGR against petitioners, and without issuing any notice, the 3rd respondent issued impugned orders, dated 01.07.2024 directing the 4th respondent to take steps for vacating petitioners from the residential house and take the custody of the same with the government under the cover of the panchanama, and the said impugned order was received by petitioners on 12.07.2024. Pursuant to the receiving the said order, petitioners filed statutory appeal vide CMA No.63/2024 before respondent No.2 and the said CMA was dismissed on 30.05.2025. Questioning the said dismissal order, petitioners filed revision petition before respondent No.1 seeking to grant stay on the order dated 30.05.2025 in CMA No.63/2024 passed by respondent No.2 and not to dispossess them from the schedule property, but no steps are taken by respondent No.1. Aggrieved by the same, this writ petition is filed.

4. Learned Government Pleader for Social Welfare appearing for respondent Nos.1 to 4 submits that the revision filed by the petitioners has been numbered as C.No.902/TW.LTR/2025, and in view of numbering, respondent No.1 will dispose of the same as expeditiously as possible.

5. In view of the same, this writ petition is disposed of directing respondent No.1 to dispose of the revision petition filed by the petitioners within a period of eight weeks from the date of receipt of a copy of this order. No order as to costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
