ORDER:
Heard Sri L.Prabhakar Reddy, learned counsel appearing for the petitioner, Ms. S.Sravanthi, learned Assistant Government Pleader for Revenue appearing for the official respondent Nos.1 to 4 and Sri P.Nagendra Reddy, learned Counsel appearing for the unofficial respondent No.5 and perused the entire material on record.
2. This writ petition is filed by the petitioner challenging the order passed by the respondent No.3 in Order No.J/936/2018, dated 04.07.2018 by setting aside the Family Member Certificate issued by the respondent No.4 in favour of the petitioner and respondent No.5 dated 15.07.2016 and the same is set aside by the RDO on the ground that the Tahsildar is not the competent authority to issue Family Member Certificate.
3. After hearing both sides and perusing the material on record, this Court is of the considered view that this Court in D.Leelavathi @ Lavanya v. Director of Mines and Geology, Hyderabad1 held that the Tahsildar is not the competent authority for granting legal heir certificate and the relevant portion of the said order is as follows:
