ORDER
Heard learned counsel for the petitioner, learned Government Pleader for Home appearing for respondent Nos.1 to 4, and with the consent of the learned counsel appearing for the parties, the Writ Petition is taken up for hearing and disposal at the admission stage.
2. Having regard to the manner of disposal of the Writ Petition at the admission stage and the nature of lis involved, this Court is of the view that notice to unofficial respondent No.5 is not necessary for adjudication of the present Writ Petition.
3. The case of the petitioner, in brief, is that, one Srinivas, claiming himself to be Station House Officer (SHO) of Siddipet II Town Police Station is summoning the petitioner to come to the 4th respondent police station under the guise of counseling without following due process of law and without issuing proper notice under Section 35(3) of BNSS, which action of the respondents-authorities it is contended as illegal and arbitrary.
4. It is the further case of the petitioner that the said Srinivas claiming himself to be CI and SHO of Siddipet II Town Police Station is threatening the petitioner to clear off loan and transfer the flat on to the name of the 5th respondent and further demanded the petitioner to pay a sum of Rs.1,00,00,000/- as permanent alimony; and that even after filing of the present Writ Petition, the petitioner’s mother had received a call on 17.07.2025, from the said person claiming himself to be Srinivas calling from mobile No.8712540663, as CI of the 4th respondent and extended threats.
5. Per contra, learned Government Pleader for Home appearing on behalf of respondent Nos.1 to 4, while denying the writ averments, submits that the SHO of the 4th respondent is one Mr.B.Upender, and there is no Officer, by name, Srinivas, working as SHO of the 4th respondent police station.
6. Learned Government Pleader further submits that the claim of the petitioner of he having received a call from Srinivas claiming himself to be the SHO of the 4th respondent police station, thus, cannot be accepted as valid claim.
7. I have taken note of the respective contentions urged.
8. Though the respondents-authorities have claimed that no complaint is received nor any case is registered against the petitioner on the file of on 17.07.2025, the petitioner having received a call from the mobile No. 8712540663 and the person calling claimed himself to be Srinivas working Government Pleader for Home has categorically denied, this Court is of the view that the petitioner should be directed to approach the 3rd respondent and submit a representation giving the details of the calls received by him from the mobile No. 8712540663 claiming the person speaking to be Srinivas, CI of the 4th respondent police station.
9. Upon the petitioner approaching the 3rd respondent authority and submitting the aforesaid representation giving the details as noted above, the 3rd respondent shall cause enquiry as to whom the said number belongs to and in what way the said person is connected with the petitioner for calling him or his family members frequently and also claiming himself to be the CI of the 4th respondent police station. On the 3rd respondent causing such enquiry, shall take further action against the person responsible for making false calls to the petitioner claiming himself to be the CI of the 4th respondent police station, which in a way amounts to impersonation, including initiation of criminal action, and also make necessary entries in his service record, if the person involved in making calls happens to be working in the Police Department.
10. Subject to above direction, the Writ Petition is disposed of. No order as to costs.
11. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
