This Criminal Petition is filed by the petitioner/accused, seeking anticipatory bail under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), in connection with Crime No.505 of 2025 on the file of Medchal Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 329(3), 324(4), 126(2), 285 of Bharatiya Nyaya Sanhitha, 2023 and Section 3 of Prevention of Damage to Public Property Act, 1984.
2. Heard Mr.K.Srujan Manohar, learned counsel for the petitioner and Mr.Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent No.1/State.
3. Learned counsel for the petitioner submits that even though the petitioner was not arrayed as an accused in the present crime, the Police insisting the petitioner to come to the police station in the absence of any allegations.
4. Learned Additional Public Prosecutor submits that the offences leveled are punishable with an imprisonment of less than seven years and the Investigating Officer will scrupulously follow the procedure as contemplated under Section 35(3) of BNSS and also guidelines issued by the Apex Court in Arnesh Kumar Vs. State of Bihar1
