This Criminal Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (for short ‘BNSS’) by petitioner/accused to quash the proceedings against him in CC.No.154 of 2023 (arising out of FIR No.29 of 2022 of Mangapet Police Station, Mulugu District) on the file of Additional Junior Civil Judge-Cum-Additional Judicial Magistrate of First Class, Mulugu. The offence alleged against petitioner is under Section 353 of the Indian Penal Code (for short ‘IPC’).
2. Heard Mr. S. M. Subhan, learned counsel for petitioner and Mr. Surepalli Prashanth, learned Assistant Public Prosecutor for respondent No.1 – State. Perused the material on record.
3. Head Constable bearing batch No.H.C.717 is de-facto complainant, lodged a complaint against petitioner on 22.02.2022, FIR No.29 of 2022 under Section 353 of IPC is registered. Charge sheet is filed on 30.11.2023.
