ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“…to issue a Writ, Order or Direction more particularly one in the nature of “Writ of Mandamus” by declaring the action of the Respondents more particularly the Respondent No.7 inspite of receiving Petitioner’s representation dt.19-03/2024 is not disconnecting the Electricity connection given to the Unofficial Respondent No.9 herein in Service Number 1100606264 & Consumer Number 113994371 in Government Land covered in Sy.No.28 of Khajaguda Village, Serilingampally Mandal, Ranga Reddy District-TS by showing House No.3-70/4 which is no way connected to Sy.No.28 of Khajaguda Village, which is a Government Land, but under the guise of the said Electricity Connection on the strength of some Unregistered Private Sale Document dt.09-06-1999 had taken said Electricity connection in the said Government Land in Sy.No.28 of Khajaguda Village and also grabbed the said Government Land and using Electricity for himself and his henchmen which is abutting to her land and also trying to grab her land. But the Respondent No.7 in contrary to The Electricity Act, 2003 & Rules, 2005 granted the said Electricity connection to the Respondent No.9 in the said Government Land and none of the official Respondents due to political influence are neither disconnecting the said Electricity Supply nor taking action on the said Respondent No.9 who has grabbed the valuable Government Land in Sy.No.28 of Khajaguda Village as arbitrary, ex-facie illegal, highhanded, discriminatory, dereliction of duty and giving colourable exercise to their statutory powers as well as violation of Article 300-A of the Constitution of India and consequently may issue Mandamus by directing the Official Respondents more particularly Respondent No.7 to disconnect the Electricity Power Supply in Service Number 1100606264 given in Government Land covered in Sy.No.28 of Khajaguda Village, Serilingampally Mandal, Ranga Reddy District- TS given to the Respondent No.9 by showing House No.3-70/4 which is no way connected to Sy.No.28 of Khajaguda Village, which is a Government Land, in the light of Petitioner’s representation dt.19-03-2024 in the interest of Justice, and may pass…”

The case of the petitioner is that the unofficial respondent No.9 has illegally encroached the Government land in Sy.No.28 of Khajaguda Village, Serilingampally Mandal, Ranga Reddy District, and has been utilizing the electricity connection vide Service No.1100606264 and Consumer No.113994371, on the basis of a fraudulent and unregistered sale deed dated 09.06.1999. Further, it is also alleged that respondent No.9 is encroaching into the adjacent property, which belongs to the petitioner. Hence, the petitioner submitted a representation to respondent No.7 on 19.03.2024, seeking to disconnect the electricity power connection to the unofficial respondent No.9. However, no action has been taken thereon so far.

Hence, the present writ petition.

The relief sought in the present writ petition pertains to electricity connection provided to the unofficial respondent No.9 in respect of the land in Sy.No.28 of Khajaguda Village, Serilingampally Mandal, Ranga Reddy District.
