THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.4870 of 2025

ORDER:

This Criminal Petition is filed seeking to quash the proceedings against the petitioners-A.1 and A.2 in Crime No.244 of 2024 of Wyra Police Station, Khammam District. The offences alleged against the petitioners are under Sections 318 (2), 296 (b), 351 (2) r/w.3 (5) of Bharatiya Nyaya Sanhita, 2023.

2. The facts of the case are that the defacto complainant-2^nd respondent lodged a report against the petitioners. A.2 is the granddaughter of A.1. A.1 misled the defacto complainant by showing wrong boundaries when they entered into agreement of sale and basing on the same registration was also done. When the defacto complainant enquired about the same the accused stated that they will rectify the mistake in the registration office and when the defacto complainant insisted for the same, A.1 and A.2 abused her in filthy language and also threatened her with dire consequences. Basing on the said complaint, the police registered the case against the petitioners for the above offences.
