HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.20153 OF 2025 ORDER : (ORAL)

This writ petition is filed by the petitioner seeking to declare the inaction of respondent No.2 in considering the petitioner’s representation dated 18.06.2025, for extension of lease period in accordance with the terms of the registered lease deed/lease agreement bearing document No.6421 of 2019 dated 18.04.2019, as being arbitrary and illegal.

It is submitted that the petitioner was granted lease by the then Kompally Gram Panchayat (now Kompally Municipality) on 18.04.2019 vide document No.6421 of 2019 for creating an eco-friendly park with all facilities including food courts, gym, walkway, jogging track, play area etc., in respect of the land admeasuring Acs.11-00 guntas in Jayabheri Layout in Sy.Nos.138, 139, 146, 149, 151 and 155 of Kompally, Gandimaisamma - Dundigal Mandal, Medchal-Malkajgiri District. 3. It is stated that the lease was granted to the petitioner pursuant to public auction conducted by the then Kompally Gram Panchayat, wherein the petitioner was declared successful bidder vide proceedings No.2368/2018.B1(P.T.S), dated 25.02.2019. It is submitted that the lease was initially for a period of one (1) year and extendable for a period of fourteen (14) years on mutually acceptable terms and conditions.

4. Heard Mr. Raghuchandra Reddy Gunna, learned counsel for the petitioner, and Mr. Putta Krishna Reddy, learned Standing Counsel for Municipalities, appearing for respondent No.2, and perused the material available on record.

5. Learned counsel for the petitioner submitted that in the year

2020, the petitioner filed W.P.No.10851 of 2020 seeking a direction to the respondent authorities not to stall or interfere in the developmental activities undertaken by the petitioner in respect of the property covered by the registered lease agreement, and interim orders dated 22.07.2020 were passed therein. While so, the petitioner submitted the representation dated 18.06.2025 seeking extension of lease in accordance with the terms of the registered lease deed dated 18.04.2019, but so far the same is not acted upon.

6. Learned Standing Counsel for respondent No.2 submitted that the representation of the petitioner will be considered in accordance with the terms and conditions of the lease deed.

In view of the above submissions, the writ petition is disposed of directing respondent No.2 to consider the representation of the petitioner dated 18.06.2025, for extension of lease, and pass orders, in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in this writ petition stand closed.
