ORDER

This Civil Revision Petition is filed for a direction to the Family Court, Medchal-Malkajgiri District at Malkajgiri to dispose of FCOP.No.420 of 2021 pending on its file as expeditiously as possible.

2. Heard Sri U.Chandra Shekar, learned counsel for the petitioner. No representation on behalf of respondent, despite service of notice on him, therefore, the Revision is being disposed of basing on the material available on record.

3. Learned counsel for the petitioner submitted that petitioner and respondent are wife and husband; that their marriage was solemnized on 04.06.2018; that out of their wedlock, they were blessed with a child, who is suffering with Parkinson disease; that the respondent, alleging that he was subjected to physical, mental and emotional torture by the petitioner, filed FCOP.No.420 of 2021 before the Family Court for dissolution of marriage; that despite the conditional order of the Family Court, the respondent is not proceeding with the matter and he is only trying to drag on the proceedings and therefore, seeks for issuance of a direction to the Family Court to dispose of the said FCOP as expeditiously as possible, by fixing a time frame.

4. Perusal of record would disclose that FCOP was filed in the year 2021 and the petitioner filed her counter and matter has been coming up for enquiry since 2022. It appears that interlocutory applications were filed by the respondent and the matter was being adjourned from time to time and the FCOP stands posted to 22.07.2025. It is relevant to note that on 14.03.2025, the Family Court has passed a conditional order directing the respondent to lead evidence in the main case i.e., FCOP, failing which, default order would be passed, however, it appears that respondent has not yet commenced evidence on his side.

In the light of the above facts and circumstances of the case and since the FCOP is of the year 2021 and further, taking into account that in spite of the conditional order passed by the Family Court, the respondent has not yet lead evidence on his behalf, this Court is of considered view that this Revision can be disposed of with a direction to the Family Court to dispose of the FCOP as expeditiously as possible.

6. Accordingly, this Revision Petition is disposed of and the Family Court, Medchal-Malkajgiri District at Malkajgiri, shall make endeavour to dispose of FCOP.No.420 of 2021 as expeditiously as possible.

7. Miscellaneous petitions pending, if any, shall stand closed.

No costs.
