ORDER

Heard Sri E.Srimanth Reddy, learned counsel for the petitioners.

2. The petitioners filed a suit in O.S.No.329 of 2022 on the file of Junior Civil Judge, Huzurabad, against the respondent/defendant seeking perpetual injunction. Along with the said suit, they have also filed an interlocutory application vide I.A.No.1205 of 2022 under Order 39 Rules 1 and 2 CPC seeking temporary injunction.

3. According to the learned counsel for the petitioners, the respondent/sole defendant has already filed counter in the said I.A. Pleadings are complete. Even then, the learned Junior Civil Judge, Huzurabad, is not disposing of the said interlocutory application in accordance with law. It is also the specific contention of the learned counsel for the petitioners that the learned trial Court granted exparte interim injunction initially and thereafter, it was not extended. Taking advantage of the same, the respondent/defendant is interfering with the possession of the petitioners over the suit schedule property. Therefore, the petitioners are seeking direction to learned trial Court to dispose of I.A.No.1205 of 2022 in accordance with law, as expeditiously as possible.

4. In the light of the said submissions and considering the fact that interlocutory application is of the year 2022 and the nature of relief sought by the petitioners herein, notice to the respondent is waived by invoking the powers of this court under Article 227 of the Constitution of India.

5. Accordingly, this Civil Revision Petition is disposed of directing the learned Junior Civil Judge, Huzurabad, to dispose of I.A.No.1205 of 2022 in O.S.No.329 of 2022 in accordance with law within one month from the date of receipt of a copy of this order.

As a sequel, the miscellaneous petitions, if any, pending in the Civil Revision Petition shall stand closed.
