ORDER
This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’) to set aside the order dated 20.01.2025 passed in Crl.M.P.No.08 of 2025 in S.S.C. No.116 of 2018 on the file of the Special Sessions Judge for Trial of Cases under SC/ST (POA) Act-cum-II Additional District and Sessions Judge, Warangal District at Hanumakonda.
2. The petitioners are arrayed as accused Nos.1 to 5 in Crime No.329 of 2024 registered for the offences punishable under Sections 324, r/w.34 IPC and Section 3(1) (x) of SC/ST (POA) Act.
3. I have heard Mr.V.Venkatram Narsaiah, learned counsel for the petitioners and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor, representing the respondent No.1-State.
4. During the trial stage, the petitioners filed a recall petition seeking to summon P.W.4 and P.W.15 for cross-examination. The basis of the petition was that their counsel was unable to attend court on the relevant dates, resulting in the absence of cross-examination of these witnesses.
