This Criminal Petition is filed by the petitioner/accused No.2 seeking to direct the IV Additional Chief Judicial Magistrate, Hyderabad, to conduct expeditious trial in C.C.No.3134 of 2020.
2. Heard Mr.Mohd Muzafer Ullah Khan, learned counsel for the petitioner and Mr.M.Ramachandra Reddy, learned Additional Public Prosecutor for respondent No.1.
3. Notice in respect of respondent No.2 is dispensed with solely on the ground that the petitioner has filed the present petition seeking to conduct expeditious trial in C.C.No.3134 of 2020, and he is not seeking any relief against respondent No.2. Respondent No.2 is arrayed only as a proforma respondent.
4. Learned counsel for the petitioner submitted that the trial Court has been adjourning the matter from time to time. He further submitted that unless this Court fixes a time limit for the conclusion of the trial and disposal of C.C.No.3134 of 2020, the petitioner will be put to great hardship.
5. Per contra, learned Additional Public Prosecutor submitted that several cases are pending before the trial court and therefore, the petitioner is not entitled to seek expeditious trial in C.C.No.3134 of
2020.
6. Having considered the rival submissions made by the respective parties and without expressing any view on the merits of the case, the learned IV Additional Chief Judicial Magistrate, Hyderabad, is directed to conclude the trial and dispose of C.C.No.3134 of 2020 as expeditiously as possible. It is made clear that the parties in lis shall cooperate with the trial Court for disposal of C.C.No.3134 of 2020 without seeking undue adjournments.
7. Accordingly, the Criminal Petition is disposed of.
Miscellaneous applications, pending if any, shall stand closed.
