O R D E R:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

“…To issue Writ, Order or Direction, or any other appropriate Order one in the nature of a WRIT OF MANDAMUS to declare the action of Respondents more particularly Respondent No 3 passing Rejection Order vide No.HCP/SCZ4/2026 dated 16/01/2026 rejecting the permission dated 05/01/2026 for conducting peaceful rally for creating awareness among the public to curve Secunderabad as new District from Hyderabad District and also not considering the representation dated 21/01/2026 for fresh permission of conducting peaceful Rally from Secunderabad Railway Station via Clock Tower Patni Chow Rasta, Manu Theatre, Paradise X Road, upto MG Road Gandhi Statue on 07/02/2026 from 10:00 AM to 01: 00 PM, as illegal, arbitrary and violation of principles of natural justice and consequently set aside the Rejection Order vide No.HCP/SCZ4/2026 dated 16/01/2026 passed by the Respondent No.3 by directing the Respondents to grant fresh permission for conducting peaceful rally from Secunderabad Railway Station via Clock Tower Patni Chow Rasta, Manu Theatre, Paradise X Road upto MG Road Gandhi Statue on 07/02/2026 from 10:00AM to 01:00 PM for creating awareness among the public to curve Secunderabad as new District from Hyderabad District by considering the representation dated

21/01/2026………”

2. Learned counsel for the petitioner submits that the petitioner is a registered society which had initially submitted a representation seeking permission to conduct a rally on 05.01.2026. The said request was rejected on 16.01.2026, allegedly without any lawful or sustainable basis. It is further submitted that thereafter, the petitioner submitted a fresh representation dated 21.01.2026, seeking permission to conduct a rally on 07.02.2026 between 10:00 A.M. and 01:00 P.M., commencing from Secunderabad Railway Station and passing through Clock Tower, Patny Chowrasta, Manju Theatre, Paradise X Road, and culminating at the Mahatma Gandhi Statue on M.G. Road. Learned counsel contends that the said representation has not been considered till date and, therefore, seeks a direction to the respondents to consider the representation and pass appropriate orders in accordance with law.

Learned Government Pleader for Home, on instructions, submits that the earlier representation submitted by the petitioner was rejected by assigning reasons, and that similar considerations may also arise in respect of the subsequent representation. However, it is fairly submitted that no order has yet been passed on the representation dated 21.01.2026, and time of one week is sought to enable the competent authority to pass appropriate orders thereon.

4. I have perused the material available on record.

5. The petitioner seeks permission to conduct a rally within the limits of Secunderabad. While it is evident that the earlier representation was rejected, the learned Government Pleader has assured that the subsequent representation would be considered independently. It is well settled that the right to assemble peacefully and express views forms part of the fundamental rights guaranteed under Articles 19(1)(a) and 19(1)(b) of the Constitution of India. At the same time, such rights are subject to reasonable restrictions in the interests of public order, as contemplated under Articles 19(2) and 19(3). Therefore, the competent authority is required to consider such requests objectively, fairly, and expeditiously, by balancing the constitutional freedoms of the citizens with the requirements of public order, traffic regulation, and security concerns.
