ORDER:

Heard Sri Kovvuri Krishna Kishore, learned counsel

representing Sri T. Vasantha Rao, learned counsel for the

petitioner and Sri Sri Harsha Reddy, learned Standing Counsel

appearing for respondent Nos.2 and 3.

2. This Writ Petition is filed seeking the following relief:

“…to issue an appropriate writ, order or direction

more particularly one in the nature of Writ of

Mandamus declaring the action of the respondents 2

and 3 in proposing to demolish the petitioner’s

house bearing Nos. 11-1-85 admeasuring 114.15

sq.yards bounded by East: Municipal Road, West:

H.No.11-1-86 belongs to T.Ramireddy (having

purchased today Smt.K.Mery Rose), North: House

belongs to Sugunakar, South: Barber shop and

H.No.11-1-86 bounded by East: Municipal Road and

house belongs to V.Ranga Reddy, which is

purchased today by you vide H.No.11-1-85

Smt.K.Mery Rose, West: Singareni Water Tank,

North: House belongs to Sugunakar, South: open

space of water tank belongs to Singareni respectively

situated at Babu Camp Area (Burma Camp Area),

Kothagudem, Bhadradri Kothagudem District,

without following due process of law and without

having any manner of right pursuant to the notices

issued in Ref.No.CRP/EST/Q/106 and Ref.No.

CRP/EST/Q/107, dated 20/01/2026 as illegal

arbitrary, violative of principles of natural justice

and also violative of Articles 14, 21 and 300-A of the

Constitution of India and consequently direct the

respondents 2 and 3 not to demolish/dispossess the

petitioner’s from H.Nos. 11-1-85 and 11-1-86

situated at Babu Camp Area (Burma Camp Area)

Kothagudem, Bhadradri Kothagudem District, and

to pass such other order or orders.”

3. Learned counsel for the petitioner submitted that the

petitioner is claiming to be the owner of house bearing

No.11-1-85 situated at Babu Camp Area (Burma Camp Area),

Kothagudem, Bhadradri Kothagudem District. The respondents

without admitting that the subject property falls under

Government land is proposing to demolish the subject house and

to that effect, notice was issued on 20.01.2026. Learned counsel

for the petitioner further submitted that without following due

process of law, the respondents ought not to have taken steps for

demolition of the subject house.

4. Learned Standing Counsel appearing for the respondents

has given an oral undertaking in the open Court that the

respondents would not proceed with demolition for a period of

three weeks so as to enable the petitioner to approach the Civil

Court for redressal of their grievance. Learned Standing Counsel

contended that the petitioner has constructed the subject house

in the land belonging to the respondents and that the petitioner

has no title over the said land. The petitioner has not filed any

documents pertaining to title, but filed documents viz., tax

payment notices and property tax payment receipts.

5. When this Court specifically questioned about ownership of

the petitioner over the subject property, the petitioner claim to be

in adverse possession of the said property for more than 30 years.

This matter involves question of title to the determined, which

cannot be examined by this Court in writ jurisdiction.

6. Accordingly, this Writ Petition is disposed of giving liberty to

the petitioner to seek appropriate remedy before appropriate

forum. There shall be no order as to costs. Miscellaneous

Petitions, if any, pending in this petition, shall stand closed.
