IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
Tirumala Devi Eada, J
Sai Kiran – Appellant
Versus
The State of Telangana – Respondent
CRIMINAL PETITION No.8407 of 2023 | C.C.No.495 of 2023
For the Appellants/Petitioners:
For the Respondents: Additional Public Prosecutor
A petition to quash an FIR becomes infructuous once a charge sheet is filed, as the legal challenge must then be directed against the charge sheet.
Headnote:The petitioner filed a criminal petition seeking the quashing of an FIR. During the pendency of the proceedings, it was submitted that a charge sheet had been filed and numbered as C.C.No.495 of 2023. The court determined that the filing of the charge sheet rendered the petition for quashing the FIR infructuous. The court addressed whether a petition to quash an FIR remains maintainable after the filing of a charge sheet. The reasoning established is that once the investigation culminates in a charge sheet, the challenge to the initiation of the process must be directed against the charge sheet itself. This criminal petition is dismissed as infructuous, granting liberty to the petitioner to challenge the charge sheet, if aggrieved.
