ORDER
This Transfer Criminal Petition is filed seeking to transfer
C.C.No.201 of 2021, pending on the file of the learned Principal
Judicial Magistrate of First Class, Bellampalli to the file of the
Special Judge for Trial of Cases under SC/ST (POA) Act, Adilabad
and to try along with Spl.S.C.No.60 of 2021.

2. Heard Sri D.Arun Kumar, learned Additional Public
Prosecutor appearing on behalf of the petitioner - State. Though
notice served upon the respondent, none appeared on his behalf.
3. Learned Additional Public Prosecutor appearing on behalf of
the petitioner submitted that two FIR Nos.25 of 2021 and 26 of
2021 arose out of the same incident dated 18.03.2021. He
contended that FIR No.25 of 2021, registered for offences under
Section 307 IPC and Sections 3(1)(r)(s) and 3(2)(v) of the SC/ST
(POA) Act, culminated in Spl.S.C.No.60 of 2021 pending before the
Special Judge, SC/ST (POA) Act, Adilabad, while FIR No.26 of 2021
resulted in C.C.No.201 of 2021 pending before the Principal
Judicial First Class Magistrate, Bellampalli. He further submitted
that since both cases arose from a common transaction, trying
them separately before different courts might lead to conflicting
decisions, and as the Special Court alone had jurisdiction to try
offences under the SC/ST (POA) Act, it was just, proper, and in the
interest of justice to withdraw C.C.No.201 of 2021 from the
Magistrate Court and transfer it to the Special Judge, SC/ST (POA)
Act, Adilabad, to be tried along with Spl.S.C.No.60 of 2021.
4. In the light of the submissions made by the learned
Additional Public Prosecutor and upon a perusal of the material

available on record, this Court is of the opinion that since the case
and counter-case arise out of the same incident, both are required
to be tried by the same Court to effectively determine the issue as
to who was the aggressor and to avoid conflicting findings.
Accordingly, C.C.No.201 of 2021 pending on the file of the
Principal Judicial First Class Magistrate, Bellampalli, is hereby
withdrawn and transferred to the Court of the Special Judge for
Trial of Cases under the SC/ST (POA) Act, Adilabad, to be tried
along with Spl.S.C.No.60 of 2021. The concerned Court shall
ensure that the records are transmitted within a period of one
month from the date of receipt of a copy of this order.
5. Accordingly, this Transfer Criminal Petition is allowed.
Pending Miscellaneous Applications, if any, shall stand
closed.
