ORDER:

This Writ Petition is filed with the following relief:

“…to issue a writ or order more particularly one in the nature of writ of mandamus declaring the action of the respondents 1 to 9 in not taking any action against the 10th respondent inspite of receipt of the petitioners written representation dated 7-8-2019 as illegal, arbitrary, unjust and against the provisions of Telangana Protection of Depositors of Financial Establishment Act 1999 and to pass...…”

3. Heard Mr.D.Pradeep, learned Assistant Government Pleader for Home.

4. Learned Assistant Government Pleader for Home submits that, pursuant to the representation of the petitioners, Crime No. 492 of 2015 was registered. After due investigation, a charge sheet has been filed, and the case has been taken on file as Calendar Case No. 38 of 2023, which is presently pending trial before the learned I Additional District Judge, Malkajgiri. The representation of the petitioners dated 07.08.2019 pertains to the completion of investigation, filing of the charge sheet, and disbursement of amounts by auctioning the properties attached pursuant to G.O.Rt.No.53 dated 17.12.2016. However, as the proceedings are now pending before the competent Court and the application for making absolute the attachment of properties referred to in G.O.Rt.No.53 dated 17.12.2016 is still under consideration, and the prosecution against the accused is ongoing, no further steps can presently be taken by the police authorities. Accordingly, it is prayed that appropriate orders be passed.

5. I have perused the material on record.

6. The contention of the petitioners is that their representation dated 07.08.2019 has not been considered by the respondent authorities. However, as rightly pointed out by the learned Assistant Government Pleader, the grievance raised in the said representation pertains to the completion of investigation in the registered crime and the disbursement of amounts by auctioning the attached properties. The developments that have transpired during the pendency of this writ petition indicate that the investigation has since been completed, a charge sheet has been filed, and the case has been numbered as Calendar Case No. 38 of 2023, which is now pending before the competent Court.

Insofar as the prayer for disbursement of amounts by auctioning the attached properties is concerned, the same is subject to the outcome of the interlocutory application pending before the trial Court seeking to make the attachment absolute and the conclusion of the prosecution. In this view of the matter, the explanation offered by the respondents/police authorities is found reasonable and justified. Since the proceedings are actively pending before the Court concerned, this Court is of the considered view that no further directions are warranted in this writ petition.

8. Accordingly, while reserving the right of the petitioners to pursue appropriate remedies and to place their case before the trial Court in accordance with law, this Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
