ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

“…to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus or any other appropriate Writ. a. To declare the actions of the Respondent Nos. 2 to 4 in illegally interfering with the peaceful functioning/working of Petitioner theater and its allied parking activities as arbitrary, unjust, illegal and violative of Article 14, 19(1)(g) and 300A of the Constitution of India and further consequently, direct the Respondents to not interfere with the activities of the Petitioner herein without following the due process of law,…”

2. Heard Mr.A.Venkatesh, learned counsel for the petitioner and Mr.D.Pradeep, learned Assistant Government Pleader for Home.

Learned counsel for the petitioner submits that though the petitioner had challenged the interference of respondent Nos. 2 to 4 in the peaceful functioning of the petitioner’s activities, during the pendency of these proceedings, G.O.Ms. No. 63, Municipal Administration and Urban Development (Plg-II(1)) Department, dated 20.03.2018, has been superseded by G.O.Ms. No. 121, MA&UD (Plg-II) Department, dated 27.10.2021, which permits stand-alone cinema theatres to operate parking on fee within their own premises. In view of the said Government Order, the grievance raised by the petitioner no longer survives for consideration. This position has also been dealt with and concluded by this Court in its common order dated 12.04.2022 in Writ Petition No. 28315 of 2019 and batch. Hence, in light of the subsequent developments, no further orders are required in the present writ petition.

4. Having considered the submissions made and recording the statement of the learned counsel for the petitioner, this writ petition is disposed of accordingly. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
