ORDER:
This writ petition is filed seeking to direct the respondents to pay compensation with all other benefits under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short RFCT LA R &R Act, 2013), read with Letter No.F/5101/2017, dated 01.08.2023 of the Revenue Divisional Officer – cum – Land Acquisition Officer (respondent No.3) to respondent No.2 – District Collector, to the petitioners towards their residential plots viz., plot No.58 (133.33 square yards) of 1st petitioner, plot Nos.60 & 77 (266.66 square yards) of 2nd petitioner, plot No.95 (133.33 square yards) of 3rd petitioner, plot No.92 (133.33 square yards) of 4th petitioner, plot No.64 (133.33 square yards) of 5th petitioner and plot Nos.59 and 78 (266.66 square yards) of 6th petitioner in Survey No.279 of Palkonda Village, Mahaboobnagar Mandal & District, which was acquired for public purpose.

Learned counsel for the petitioners draws attention of this Court to the communication dated 01.08.2023 addressed by respondent No.3 – Revenue Divisional Officer, Mahabubnagar Division to respondent No.2 – District Collector, Mahabubnagar District, wherein it is submitted that funds were sanctioned towards payment of compensation to a tune of Rs.25,37,09,000/- and awards were passed requesting for authorization for drawing the balance amount of Rs.3,98,47,320/- and in the said communication, the details of the petitioners / awardees, their respective bank details and the amounts to be deposited were furnished.

Learned Assistant Government Pleader for Land Acquisition appearing for respondents on instructions of Revenue Divisional Officer & Land Acquisition Officer, Mahabubnagar – respondent No.3 would submit that the Government vide G.O.Rt.No.663, Revenue (DA-Cmrf) Department, dated 03.11.2017 issued administrative sanction for construction of New Collectorate Building / Integrated District Office Complex for Mahabubnagar. A notification was issued by respondent No.3 under Section 11 of the RFCT LA R &R Act, 2013 read with RFCT LA R &R (Telangana Amendment) Act, 2016 vide Ref. No. F/5101/2018, dated 15.09.2018 to an extent of Ac.11-17 guntas of agricultural land and 53,924.66 square yards of plotted area for acquisition of land bearing Survey Nos.247, 278, 279/4 & 5 situated in the limits of Palakonda Village of Mahabubnagar Urban Mandal. It is further submitted that the then Revenue Divisional Officer issued draft declaration for an extent of Ac.5-09 guntas and 8865.16 square yards and an Award was passed by the Revenue Divisional Officer, Mahabubnagar vide Award No.F/5101/2017, dated 18.05.2022, wherein the writ petitioners were included as awardees. Subsequently, the Government vide memo No.13414/DA/2020-2, Revenue (DA) Department, dated 16.08.2019 sanctioned budget to a tune of Rs.25,37,09,000/- to quarterly regulation orders pending provision of funds by way of obtaining supplementary grants at the appropriate time during the financial year 2022-23 towards payment of land acquisition for construction of new Collectorate building in Palakonda Village of Mahabubnagar Mandal & District. Thereafter, the bank account details of the writ petitioners were obtained and orders to that effect were passed on 29.03.2023 vide proceedings No.F/5101/2017 sanctioning an amount of Rs.93,33,100/- and the same was not sanctioned. Thereafter, letters were addressed to the Government with a request to re-authorize the Head of Account towards making payment of Rs.3,98,47,320/- including the compensation entitled by the writ petitioners.
