ORDER: (Per Hon’ble Justice Moushumi Bhattacharya)

1. The alleged detenue, who is a minor child of 14 years and is currently studying in Class IX, is present in Court. Upon being asked specific questions, the alleged detenue has unequivocally expressed her wish to stay with her mother (the respondent No.4). However, the alleged detenue also expressed her desire to meet and spend time with her father (the petitioner), two to three times a week. The alleged detenue is willing to meet her father both at her home (where her mother stays) as well as outside her home.

2. Learned counsel appearing for the petitioner/father submits that the petitioner may not be inclined to meet the alleged detenue (his daughter) at his wife’s residence since the couple have been separated since 2020. Counsel suggests that the petitioner may spend time with the alleged detenue on every alternate day of the week after school hours.

3. Considering the fact that the alleged detenue is presently studying in Class IX, we do not find it feasible to permit the petitioner to meet the alleged detenue every alternate day after school hours, as such an arrangement would hamper her studies. We have also asked the alleged detenue to specify the duration of time she wishes to spend with her father and the number of days per week she prefers to do so. The alleged detenue has stated that she intends to spend three hours every Thursday and the whole of Sunday with her father every week.

4. W.P.No.829 of 2026, along with all connected applications, is accordingly disposed of by permitting the petitioner to meet the alleged detenue for three hours every Thursday after 5:00 P.M. and every Sunday from 9:00 A.M to 6:00 P.M. The Child Welfare Committee is directed to hand over the custody of the alleged detenue to the respondent No.4 (the mother of the alleged detenue) during the course of the day.

There shall be no order as to costs.
