WP 39094/2022
IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HON’BLE SRI JUSTICE K.SARATH WRIT PETITION No.39094 of 2022 DATED: 21.01.2026 Between:
1. Meghavath Charansingh and another …Petitioners AND
1. The State of Telangana, represented by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and eleven (11) others …Respondents
ORDER:
1. This Writ Petition is filed questioning the orders dated 23.01.2021 passed by the Special Tribunal, Vikarabad District/Respondent No.2 in Case No.D1/284/RDO/VKB/
Spl.TB/2021, C/1385/2020.
2. Heard Sri C.Naresh Reddy, learned Counsel for the petitioners, Mrs.S.Sravanthi, learned Assistant Government Pleader for Revenue appearing for the official respondents and Sri Nayakwadi Ramesh, learned Counsel appearing for the unofficial respondent Nos.5 to 12.
3. Learned Counsel for the petitioners submits that the unofficial respondents herein have filed appeal under Section 5 (5) of the Telangana Rights in Land and Pattadar Pass Books Act, 1971 (for short ‘the Act, 1971’) before the Revenue Divisional Officer/Respondent No.3 against the writ petitioners herein. Pending the said appeal, ROR Act, 2020 came into force, constituting Special Tribunals, the Appeal was transmitted to the Special Tribunal/Respondent No.2 and the Special Tribunal without issuing any notices to the petitioners herein or unofficial respondents, disposed of the appeal on 23.01.2021 and directed the parties to approach the Civil Court and in the meantime to maintain status quo over the subject property and not to effect any transfers over the subject lands till determination of the rights of the parties by the competent civil Court and said the action of the respondent No.2 is contrary to the orders passed by the Division Bench of this Court in WP PIL No.20 of 2021 dated
18.03.2021 and requested to remand back the matter for reconsideration.
4. The learned Counsel for the petitioners would further submit that after filing the instant writ petition, the Telangana Bhu Bharathi (Record of Rights in Land) Act, 2025 (for short ‘Bhu Bharathi Act, 2025’) came into force and in view of the same, the appeal has to be remanded back to the 1st appellate authority/Revenue Divisional Officer under the Bhu Bharathi Act, 2025 and the Rules made thereunder and requested to remand back the matter to the 1st appellate authority for fresh consideration.
5. On the other hand, the learned Assistant Government Pleader and the learned Counsel for the unofficial respondents have fairly conceded that the Special Tribunal/respondent No.2, without issuing notices to the petitioners as well as the unofficial respondents passed impunged order and requested to pass appropriate orders.
6. In view of submissions made by both sides, this writ petition is disposed of by setting aside the impugned Order dated 23.01.2021 passed by the Special Tribunal, Vikarabad District/Respondent No.2 in Case No.D1/284/RDO/VKB/Spl.TB/2021, C/1385/2020 and the matter is remanded back to the respondent No.3/Revenue Divisonal Officer, Vikarabad, being the 1st appellate authority as per Section 15 of the Bhu Bharathi Act and Rule 14 (2) of Bhu Bharathi Rule, 2025. After remanding the matter the respondent No.3 is directed to issue notices to the petitioners as well as the unofficial respondents herein, including personal hearing and pass appropriate orders as per law, as expeditiously as possible.
No order as to costs.
Miscellaneous applications pending, if any, in this Writ Petition, shall stand closed.
