ORDER:
This Transfer Criminal Petition is filed under Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner seeking to transfer the C.C.No.139 of 2020, on the file of the learned VII Metropolitan Magistrate, at Hayathnagar, Rangareddy District, to the Court of the learned Judicial 1st Class Magistrate, Principal District Judge’s Court Complex, Khammam, registered for the offences punishable under Sections 138 and 142 of the Negotiable Instruments Act. 2. Heard Sri P. Venkatesh, learned counsel for the petitioner and Sri E. Ganesh, learned Assistant Public Prosecutor for respondent No.2-State.

Learned counsel for the petitioner submitted that the petitioner and respondent No.1 are the resident of Khammam District and only to harass the petitioner herein, respondent No.1 deposited the cheque in Hayathnagar Branch and filed criminal case in Rangareddy Court and the petitioner being the resident of Khammam, he cannot travel for each and every occasion from Khammam District to Rangareddy District. Hence, he prayed this Court to transfer the C.C.No.139 of 2020, on the file of the learned VII Metropolitan Magistrate, at Hayathnagar, Rangareddy District, to the Court of the learned Judicial 1st Class Magistrate, Principal District Judge’s Court Complex, Khammam.

In view of the submissions made by the learned counsel for the petitioner, and since the petition has been filed by the accused seeking transfer of a case under the Negotiable Instruments Act, and in light of the judgment of the Hon’ble Apex Court in the case of Kasthuripandian S Vs. RBL Bank Limited, 2024 LiveLaw (SC) 427, such transfer cannot be allowed at the instance of the accused in an NI Act case. Considering the same, the attendance of the petitioner before the Hayathnagar Court is dispensed with. However, the petitioner is directed to appear before the trial Court whenever his presence is required, through his counsel.
5. With the above observation, this Transfer Criminal Petition is disposed of.
Pending Miscellaneous Applications, if any, shall stand closed.
