ORDER:

This Writ Petition is filed with the following relief:

“…to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent Nos.2 to 5 in not completing the investigation in Crime No.1090/2018 dated 18-12-2018 on the file of PS KPHB Colony, Cyberabad and Crime No. 307/2019 dated 19-3-2019 on the file of L.B.Nagar L and 0 P.S. Rachakonda Commisionerate/Ranga Reddy district registered against the respondent Nos.7 to 9 under Section 420 of Indian Penal Code is illegal, arbitrary and being Violative of Article 14, 16 and 21 of the Constitution of India and also relevant provisions governing the completion of investigation and to file the charge sheet under the Criminal procedure code and seeking consequential direction to hand over the case to the Central Bureau of Investigation i.e. 6th respondent...”

2. Heard Mr. V.Krishna Swaroop, learned counsel for the petitioner and Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing on behalf of respondent Nos.1 to 5 and Mr. T. Srujan Kumar Reddy, learned Special Public Prosecutor for CBI, appearing on behalf of respondent No.6.

Learned counsel for the petitioner submits that as respondent Nos. 2 to 5 have failed to complete the investigation in Crime No. 1090 of 2019, which was subsequently transferred to LB Nagar Police Station and re-registered as Crime No. 307 of 2019, the present writ petition has been filed seeking appropriate directions.

4. Learned Assistant Government Pleader for Home, on instructions, submits that Crime No. 307 of 2019 of LB Nagar Police Station has been duly investigated, and upon completion of the investigation, a charge sheet was filed and taken on file as C.C. No. 990 of 2021 on the file of the II Additional Metropolitan Magistrate, LB Nagar. The case is presently pending trial. In view of the above, it is contended that the grievance of the petitioner does not survive for consideration, and accordingly, he prays that the writ petition be dismissed.

5. I have perused the material available on record.

6. The grievance of the petitioner is that the respondent police have not conducted a proper investigation in the registered crime. However, as reported by the learned Assistant Government Pleader for Home, the investigation has already been completed, a charge sheet has been filed, and the matter is currently pending trial before the competent criminal court. In view of these developments, it is evident that the grievance of the petitioner has been effectively addressed by the respondent police authorities. In this view, nothing further remains for consideration in this writ petition.

7. Accordingly, the writ petition is dismissed as infructuous.

There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
