This Writ Petition (Tr.) is filed seeking to declare the action of the respondents in not considering the case of the petitioner for promotion to the post of Superintending Engineer, without reference to C.C. No.32 of 2007 pending on the file of learned Additional Special Judge for SPE and ACB Cases, Hyderabad, as illegal and arbitrary.

2. Heard Sri G.Venkata Krishnaiah, learned counsel for the petitioner and learned Government Pleader for Services-I appearing for respondent Nos.1 and 2.

Learned counsel for the petitioner submitted that the petitioner was acquitted from Criminal Case vide judgment dated 29.10.2019 in C.C.No.32 of 2007, and therefore, he is entitled to be considered for promotion to the post of Superintending Engineer as per G.O.Ms.No.529, General Administration (Services-C)

Department, dated 19.08.2008.

Learned Government Pleader for Services-I appearing for the respondents, on instructions, submits that during the pendency of the Writ Petition (tr.), the petitioner was retired from service on 31.05.2019 and that he was acquitted from the Criminal case vide C.C.No.32 of 2007 dated 29.10.2019. He further submitted that the Anti Corruption Bureau filed a Criminal Appeal vide Crl.A.No.431 of 2020 before this Court and the same is still pending. Further, the entire retirement benefits pertaining to the petitioner was paid to him vide proceedings Lr.No.PAG(A&E)/P19/II/K-749/SP770/2020-

01/2331 dated 22.10.2024.

At this juncture, learned counsel for the petitioner prays this Court to permit the petitioner to submit a representation to the respondents seeking promotion to the post of Superintending Engineer and that the respondents may be directed to consider the same, within a stipulated period of time.

6. Having regard to the submissions made by learned counsel for the respective parties, the Writ Petition (TR) is disposed of, permitting the petitioner to submit a representation for redressal of his grievance, within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of such a representation, the respondents are directed to consider the same, in terms of G.O.Ms.No.529 dated 19.08.2008, and pass appropriate orders thereon, strictly in accordance with law, as expeditiously as possible, preferably within a period of six (06) weeks therefrom and communicate a copy of the same to the petitioner.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
