ORDER :

This writ petition is filed by the petitioner seeking to declare the action of respondent authorities in not removing the unauthorized structures/shops on the public road and footpath in front of “Vertex Pearl” building situated at Srinivasa Nagar, Kapra, Hyderabad, as being illegal, arbitrary and violative of Articles 14, 21, 300-A of the Constitution of India.

2. Heard Mr. Shreyas Reddy Y, learned counsel for the petitioner, Mr. R. Sameer Ahmed, learned standing counsel for HYDRAA, appearing for respondent No.2, and Mr. G. Madhusudhan Reddy, learned standing counsel for the GHMC, appearing for respondent Nos.3 and 4.

It is stated that the petitioner is owner and possessor of Shop Nos.9 and 10 situated on the ground floor of building by name, Vertex Pearl, bearing Door Nos.1-1-268/G9 & 1-1-268/G10, situated at Srinivasa Nagar, Kapra, Hyderabad, having acquired the same under gift deed dated 12.08.2011. It is further stated that some unknown individuals unlawfully encroached the public road and footpath in front of the subject property by erecting temporary structures for commercial use. The same is causing severe inconvenience and hardship to the petitioner and other co-owners of the Vertex Pearl building. The petitioner submitted detailed representation dated 30.10.2025 to respondent No.2 to remove the illegal encroachments made on streets, public road and footpath. As there is delay on the part of respondent No.2 in acting upon the representation, the petitioner is constrained to approach this Court.

4. Learned standing counsel for HYDRAA and learned standing counsel for GHMC submitted that appropriate action will be taken on the representation of the petitioner, in accordance with law.

Recording the aforesaid submission of learned standing counsel for the GHMC, and learned standing counsel for HYDRAA, the writ petition is disposed of, directing respondent Nos.2 and 4, to consider the representation of the petitioner dated 30.10.2025 for removing unauthorized structures and shops on the public road and footpath in front of Vertex Pearl building situated at Srinivasa Nagar, Kapra, Hyderabad, and pass orders, in accordance with law, by issuing notice to the petitioner, and all other concerned/interested persons and alleged encroachers, by affording them an opportunity of hearing, within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
