ORAL ORDER

This Civil Revision Petition is filed under Article 227 of the Constitution of India, seeking a direction to the learned I Senior Civil Judge-cum-Chief Judicial Magistrate, Kukatpally, Medchal – Malkajgiri District, to dispose of O.S.No.158 of 2022 filed by the petitioner against the respondents for recovery of possession mesne and profits, in accordance with law, within a period of six (6) months.

Petitioner filed the present revision seeking a direction to the learned trial Court to dispose of the said suit contending that the respondents are delaying the suit proceedings on one pretext or the other, due to which, the suit is pending without coming to a logical end. It is also her contention that she is a Senior Citizen.

3. Perusal of the plaint filed by the petitioner herein would reveal that she was aged about 62 years as on the date of filing of the said suit. She is now aged 69 years old. She is a Senior mesne Citizen. The suit is filed for recovery of possession and profits. The year 1999 was observed as “International Year of Older Persons”. In view of the “National Policy for Older Persons” adopted by the Government of India, the erstwhile High Court of Andhra Pradesh at Hyderabad issued a Circular vide ROC.No.4790/1999/OP Cell-E, dated 02.11.1999 directing all the Judicial Officers in the State to identify and dispose of matters in which persons above “65 years” of age are involved, on priority basis. Subsequently, erstwhile the High Court of Andhra Pradesh issued Circulars vide ROC.No.3465/E-1/2003, dated 05.12.2003, ROC.No.1230/OP Cell-E/2005, dated 20.08.2005 and ROC.No.3465/E-1/2003, dated 14.12.2011 and the High Court of Judicature at Hyderabad for the States of Telangana and Andhra Pradesh vide Circular in ROC.No.5226/OP Cell-E/2014, dated 20.12.2014, in which specific instructions are issued to give priority to the cases relating to senior citizens for the expeditious disposal. In the light of the same, notice to respondent No.2 – defendant No.2 is waived of by invoking power of this Court under Article - 227 of the Constitution of India.

In view of the aforesaid discussion, this Civil Revision Petition is disposed of directing learned I Senior Civil Judge- cum-Chief Judicial Magistrate, Kukatpally, Medchal – Malkajgiri District, to make an endeavor to dispose of O.S.No.158 of 2022, strictly in accordance with law, as expeditiously as possible.

5. With the above direction, this Civil Revision Petition is disposed of.

As a sequel thereto, miscellaneous petitions, if any, pending in the Civil Revision Petition shall stand closed. There shall be no order as to costs.
