ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“…to issue a writ of mandamus or any other appropriate writ declaring the action of the respondent No.1 to 4 in not considering the petitioner representations dt. 16-04-2024, 29-11-2024 and 28-01-2025 submitted to appoint her in any other post which is equivalent to the Jr. Asst. cum Typist (presently which petitioner discharging) or any other post as per petitioner’s qualification or the lower post to present post as per the Circular Memo No.60681/Ser.A/2003-1 dt.12-08-2003 and also in not considering the recommendations of the respondent No.2 vide his letter No.A2/15/2016, dt.06-01-2025 by the respondent No.4 for appointing her as Jr. Assistant or any other posts which petitioner is entitled, as illegal, arbitrary and unconstitutional and consequently direct the respondents No.1 to 4 to consider the case of the petitioner for appointment as Jr. Assistant or any posts which is equivalent to the Jr. Asst. cum Typist or any other post which is lower than the post presently discharging and regularize her services and pass…”

2. Heard Sri K. Jagadishwar Reddy, learned counsel appearing for the petitioner, learned Government Pleader for Services-II, for respondent No.1, and learned Government Pleader for Services-I, on behalf of respondent Nos.2 to 4.

3. Learned counsel for the petitioner submits that the petitioner’s mother, Smt. P. Krishna Kumari, passed away on 16.02.2015, while serving as a School Assistant at ZPHS Girls High School, Manugur Municipality. As such, considering the petitioner’s request, she was offered compassionate appointment as Junior Assistant vide proceedings dated 17.03.2017, subject to the condition that she shall acquire Degree qualification within five years of her appointment, and was posted at the office of the District Backward Class Development Officer, Bhadradri Kothagudem District. However, when the petitioner reported to duty, she was sent to respondent No.2, who later issued modified orders dated 27.03.2017, appointing the petitioner as Typist, and included an additional condition of acquiring Typewriting English and Telugu (Higher) qualifications within the prescribed period. It is submitted that while the petitioner acquired the Degree qualification in the year 2020 and Typewriting (Lower grade), she could not secure the Typewriting Higher qualification in English and Telugu, and thus, her services could not be regularized. As such, the petitioner submitted her representation to respondent No.2 on 07.08.2021, seeking modification of her post from Typist to Junior Assistant.

It is further submitted that as per Government Circular Memo.No.60681/Ser.A/2003-1 dated 12.08.2003, if a candidate could not acquire the prescribed qualification within the allotted time, he/she shall be considered for appointment to the lower post, on the request of the individual. As such, in pursuance of Memo dated 08.05.2024 issued by respondent No.4, the petitioner submitted her willingness to accept the lower post and requested retrospective regularization of her services, w.e.f., 04.04.2017, and the petitioner also submitted her willingness letter to respondent No.4 on 25.11.2024. Thereafter, the petitioner submitted a representation to respondent No.2 on 29.11.2024, requesting modification of her post to any other equivalent or lower category post to that of Typist, duly regularizing her services, w.e.f., 04.04.2017. Subsequently, she has also submitted another representation to the respondents on 28.01.2025, seeking modification of her designation from Typist to Junior Assistant-cum- Co
