O R D E R

This Criminal Petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner/Accused No.4 seeking his enlargement on bail in connection with S.C.No.111 of 2021 on the file of the learned VIII Additional Chief Judicial Magistrate, Ranga Reddy District, Chevella, on bail, the present Criminal Petition is filed.

2. The brief facts of the case are that the petitioner was shown as accused No.4 in S.C.No.111 of 2021 arising out of Crime No.34 of 2021 of Dundigal Police Station. The case was registered for the offences punishable under Sections 395 and 411 IPC and Section 25(1B)(b) of the Indian Arms Act, and after investigation, the charge sheet was filed for the offence under Section 395 IPC. The prosecution alleged that, on the intervening night of 06 or 07.01.2021, seven unknown persons entered the Cashmere Court Villas venture at Mokila Village, assaulted and tied up the security guards and the security supervisor, beat the wife of the supervisor, stole electrical wires worth about Rs.5,00,000, disturbed the CCTV cameras, and fled in a vehicle. The accused were alleged to have committed the theft by intimidating and assaulting the security personnel. Pursuant to a Non-Bailable Warrant issued by the Magistrate, the petitioner was arrested on 02.06.2025, produced before the Court, and remanded to judicial custody, where he remained thereafter and earlier, this Court vide order dated 19.08.2025 had disposed of the bail petition of accused No.1 in the similar case by directing the trial Court to expedite the trial and dispose of the case at the earliest and according to the prosecution, it was coming for the investigating officer evidence on 06.01.2026 and on that date, the Investigating Officer was not examined and the next date is 19.01.2026.

3. Heard Sri Thakur Vikas Singh, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent – State.

The learned counsel for the petitioner submitted that the petitioner was remanded to the judicial custody on 02.06.2025 and though the petitioner is in jail from the last seven months, there is no possibility of conclusion of the trial, as such, he requested the Court to grant bail to the petitioner and the petitioner will appear before the trial Court, whenever his presence is required.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, stating that the petitioner herein is involved in several similar cases, and if he is released on bail, he will repeat the same and he will not attend the trial Court. Therefore, he prayed that the criminal petition be dismissed.

In the light of the submissions made by both the learned counsel and perusal of the material available on record, it is noticed that the trial Court, at the stage of examination of the Investigating Officer, had posted the case on 19.01.2026. In these circumstances, this Court deems it fit to direct the trial Court to dispose of the case within a period of one (01) month from the date of receipt of a copy of this order.

7. With the above direction, this Criminal Petition is disposed of.

Miscellaneous applications, if any pending, shall stand closed.
