ORDER:

This Writ Petition is filed seeking the following relief:

“...to issue Writ, order, direction of the Writ more particularly one in the nature of Writ of Mandamus declaring the removal order passed by the 3^rd respondent vide proceedings No.P.VIII-1/2001-ESTT.3 dated 1.12.2001, the 2^nd respondent proceeding No.R-XIII-3/2002-Adm-I, dated 29.5.2002 and also the 1^st respondent proceedings No.R.XIII- 70/07-Pers.III(L) dated 20.8.2007 as illegal, arbitrary, unjust and violation of the Article 21 of the Constitution of India and consequently set aside the same by directing the respondents to reinstate the petitioner into service with continuity of service attendant benefits and back wages...”

2. Heard Sri B. Shiva Kumar, learned counsel for the petitioners and learned Assistant Solicitor General of India appearing for the respondents.

3. The petitioner No.1 was appointed as Constable in the Central Reserve Police Force on 16.10.1980 and completed training in CRPF

64 Battalion, Assam. After completion of his training, the petitioner No.1 was posted at 12^th Battalion, Assam, and later he was promoted for constable to LNK (Lance Naik), from Lance Naik to Naik. Further he was promoted as Coy. Hawaldar Major (C.H.M) to the post Head Constable, and completed his 21 years of service in the department. While so, on 17.05.2001, the petitioner No.1 was kept under suspension and issued articles of charges. On proving charges, respondent No.3 issued orders dated 01.12.2001 removing the petitioner No.1 from services. Aggrieved by the said removal order, the petitioner No.1 filed an appeal before respondent No.2, and the same was dismissed by order dated 29.05.2002. Questioning the said dismissal order, this writ petition is filed.

4. Learned counsel for the petitioners submitted that during the pendency of this writ petition, petitioner No.1 died on 04.08.2020. Learned counsel further submitted that petitioner Nos.2 to 4, who are the legal heirs of petitioner No.1, would submit an application before the authorities for consideration of compulsory retirement of petitioner No.1.

Recording the submissions of the learned counsel for the petitioners, this writ petition is disposed of directing petitioner Nos.2 to 4 to submit an application before the respondent authorities within a period of two (2) weeks from the date of receipt of a copy of this order. On receipt of such application, the respondent authorities are directed to pass appropriate orders in accordance with law, within a period of eight (8) weeks therefrom. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, in this Writ Petition, shall stand closed.
