ORDER:

Heard Sri N. Manga Shree, learned counsel for the petitioner and learned Government Pleader for Home appearing for respondent Nos.1 to 6. With their consent, this writ petition is being taken up for disposal at the admission stage itself.

2. This writ petition is filed seeking the following prayer:

“…Declaring the action of the respondents in not registering the FIR in pursuant to the complaints of the petitioner dated 14.01.2025, 21.04.2025 & 22.08.2025 against the unofficial respondent Nos.7 to 12 though they have committed cognizable offence repeatedly as illegal, arbitrary, unconstitutional, violative of Principles of natural justice and contrary to the judgment of the Hon’ble Supreme Court and consequential direction to the official respondents to register the FIR against the unofficial respondents duly effecting the arrest of the accused and conduct investigation by following due procedure of law …”

3. Petitioner submits that in the year 2019, he was married to one Smt. Ruksana begum and blessed with two children. After marriage, disputes arose between the petitioner and his wife. Petitioner submits that his wife subsequently goes to her parents house and did not care and when petitioner went to his in-laws to bring his wife back to the home, they threatened the petitioner with dire consequences due to which the petitioner is unable to do any of his work. The petitioner also conducted pahchayath in the presence of elders of the village, however, did not materialise. Petitioner made a complaint on 24.11.2022 stating that the accused are threatening him with dire consequences and when no action was taken, he made a representation on 08.12.2022 by way of registered post. It is further submitted that on 14.04.2024, his in-laws attacked him and when he was trying to dial 100, his phone was snatched. Petitioner on 15.04.2023 had approached respondent No.6 and made complaint against them to take action and again on 05.06.2024 made another complaint to respondent Nos.2 to 5 to protect his life from threat and take legal action. Aggrieved by the inaction on the part of the respondent officials, petitioner filed W.P.No.36981 of 2024. The said writ petition is pending. Thereafter, the unofficial respondents attacked the petitioner on 14.01.2025 and petitioner lodged a complaint but no action was taken and again on 21.09.2025 another complaint was made and lastly a complaint was made on 22.08.2025. However, respondent Nos.3 to 6 have neither registered F.I.R nor conducted preliminary enquiry. Questioning the same and that petitioner has threat to his life and liberty in the hands of the unofficial respondents and questioning the inaction of respondent Nos.3 to 6, the present writ petition is filed.

4. Learned Government Pleader for Home submits that basing on the complaint lodged by the petitioner dated 15.11.2025, F.I.R.No.412 of 2025 dated 15.11.2025 was registered in the P.S. Zaheerabad, Sangareddy District against the unofficial respondent Nos.7 to 10 for the offences punishable under Sections 126 (2), 351 (2) and 352 r/w. Section 3(5) of BNS and also stated that respondent Nos.7 to 10 have been added as accused in the said F.I.R. It is further submitted that in serial No.1 of the F.I.R, respondent No.7 was arrayed as accused, in Serial No.2 respondent No.8 was arrayed as accused and in Serial No.3, respondent No.10 was arrayed as accused and in Serial No.4, respondent No.9 and two others were arrayed as accused of the F.I.R.

5. Learned counsel for the petitioner submitted that though complaint was lodged against respondent Nos.11 and

12 along with respondent Nos.7 to 10, respondent Nos.11 and 12 were not arrayed as accused.

6. Per contra, the learned Government Pleader for Home submits that as per serial No.4 in the said F.I.R, respondent No.9 along with two others were arrayed as accused and in the course of further enquiry, if respondent Nos.11 and 12
