ORDER:

This Criminal Petition is filed under Section 528 of the Bharatiya

Nagarik Suraksha Sanhitha (BNSS, 2023), seeking quashment of the

order dated 07.11.2023 passed in Crl.M.P. No. 98 of 2022 in M.C.

No.7 of 2022 on the file of the learned VI Additional District and

Sessions Judge-cum-Family Court, Rangareddy District at Kukatpally.

2. Heard Mr. Sushil Kumar Pandey, learned counsel for the

petitioner, Mr. Steven Jai Deep, learned counsel for respondent No.1,

and Mr. E. Ganesh, learned Additional Public Prosecutor, appearing

for respondent No.2–State.

3. The impugned order granted interim maintenance of Rs. 15,000/-

in favor of respondent No.1. During the hearing, learned counsel for

the petitioner submitted that, considering the circumstances of the

case, the petitioner has filed an application under Section 127 of the

Criminal Procedure Code (Cr.P.C.) seeking modification of the

maintenance order. Further, by expressing readiness to cooperate with

the enquiry/trial, the petitioner prays for a direction to the trial Court for

the expeditious adjudication of the Maintenance Case.

4. Learned counsel for respondent No.1 submitted that the

Maintenance Case is presently listed for further evidence of the

petitioner, and reported no specific objection regarding a direction for

the early disposal of the matter.

5. Having regard to the submissions of both parties and in view of

the fact that the Maintenance Case has been pending since 2022, the

learned VI Additional District and Sessions Judge-cum-Family Court,

Rangareddy District at Kukatpally, is directed to prioritize the

proceedings and adjudicate Maintenance Case No. 7 of 2022

expeditiously, preferably within three (03) months from the date of

receipt of a copy of this order.

6. This direction is in accordance with the mandate of Section 125

Cr.P.C., which requires courts to ensure the timely enforcement of

maintenance rights, and to uphold justice for all parties, maintenance

proceedings should be disposed of at the earliest possible opportunity.

7. With the above direction, this Criminal Petition is disposed of.

Miscellaneous petitions, pending if any, shall stand closed.
