Questioning the rejection order dated 27.01.2026 passed by the
respondent No.5, Municipal Commissioner, Adilabad Municipality,
in respect of representation dated 17.01.2026 submitted by the
petitioner for inclusion of petitioner’s name in the Adilabad
Municipality Electoral Rolls, petitioner filed the present writ petition
with a consequential prayer to direct the respondent No.5 to include
the petitioner’s name in the Electoral Roll of Ward No.6 of Adilabad
Municipality.
2. Learned counsel for the petitioner would submit that the
petitioner is the citizen of India and a registered elector bearing EPIC
No.TUY0741496 and was residing at Kachkanti village, Adilabad Rural
Mandal, from where she was elected as a Ward Member.
Due to marriage and lawful change of residence, she sought shifting of
electoral particulars and her name was recorded by the Election

Commission of India however her name was not mapped to Ward No.6
in the municipal electoral roll. Thereafter, considering the
representation dated 17.01.2026 of the petitioner, respondent No.5
passed impugned rejection order on the ground that the petitioner
Form-8 application dated 09.01.2026 was filed after the qualifying
date of 01.10.2025. Challenging the same, petitioner filed the present
writ petition.
3. On the other hand, learned Government Pleader appearing for
the respondents has placed a copy of the instructions of the
respondent No.5 wherein it is stated that in terms of Section 195-A of
Telangana Municipalities Act, 2019, the Assembly Constituency
Electoral Rolls published by the Election Commission of India under
the Representation of Peoples Act, 1950 with reference to the
qualifying dated 01.10.2025 as updated upto 15.11.2025 under
Section 22 and 23 of Representation of Peoples Act, 1950 is adopted
by the State Election Commissioner, for preparation and publication
of Ward-wise electoral rolls of the Urban Local Bodies. Further,
with reference to the qualifying date as on 01.10.2025, the mapping of
voters in the respective Divisions/Ward is carried out by the
Municipal Commissioners strictly in accordance with the delimitation
of the Wards. It is further stated that on verification, name of the
petitioner was not mapped and not found in Ward No.6 of Adilabad
Municipality voter list and her serial number in the Assembly
Constituency of ECI finds place at Part No.260 Sl.No.761. The request

for inclusion of the name in the voters list of the Municipalities
electoral rolls are considered in terms of Section 195-A of the
Telangana Municipalities Act, 2019. In view of the above, the request
of the petitioner for inclusion of her name in the voters list of Ward
No.6 of Adilabad Municipality is not acceptable at this stage as the
name of the petitioner is not updated in the official website of Chief
Electoral Officer of the State of Telangana, as on qualifying date of
01.10.2025 which is updated upto 15.11.2025.
The learned Government Pleader would further submit that
based on the record, the petitioner has participated in the
Parliamentary elections in Ward No.6 from Adilabad Rural at
Kachkanti village Grampanchayat as the Election Commissioner of
India had already issued the Voter Identification Card, which was
downloaded by the petitioner on 16.01.2026. Based on the records
updated by the Electoral Registration Officer, name of petitioner was
not uploaded as on the cut off date i.e. 01.10.2025 however,
the petitioner may exercise her voting rights with the updated records
for future elections.
