ORDER :

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“…pleased to issue an appropriate writ, order, or Direction, more particularly one in the nature of WRIT OF MANDAMUS, declaring the action of Respondent No. 2 to 4 for not issuing the Pattadar Pass Book to the Petitioner to the extent of Ac. 1-26 gts in Sy.No.624/1 situated at Velimala Village, Ramachadrapuram Mandal, Sangareddy District (erstwhile Sy.No.377, situated at Kondakal Village, Shankerpally Mandal, Rangareddy District) by considering the representation made by the Petitioner through Online vide Application No.2500000454 dated 03.01.2025 as illegal, arbitrary and against Article 300-A of the Constitution of India, and violation of principles of natural justice and consequently direct to the Respondent No. 2 to issue the pattadar pass book to the extent of Ac.1-26 gts in survey No.624/1 Velimala Village, Ramachadrapuram Mandal, Sangareddy District (erstwhile Sy.No.377, situated at Kondakal Village, Shankerpally Mandal, Rangareddy District)…”

2. Heard Ms. Jyotsna Devi, learned counsel representing Sri Nallamasu Krishna, learned counsel for the petitioner and Sri L.Ravinder, learned Assistant Government Pleader for Revenue, for respondent Nos.1 to 4 and perused the record.

Learned counsel appearing for the petitioner would submit that the petitioner herein is the absolute owner and possessor of agricultural land to an extent of Ac.1-26 gts in Sy.No.624/1, situated at Velimala Village, Ramachadrapuram Mandal, Sangareddy District, which was formerly part of Sy.No.377, situated at Kondakal Village, Shankerpally Mandal, Rangareddy District. The Government of Andhra Pradesh had assigned the subject land to the petitioner under proceedings vide No.B/388/1985, dated 19.09.1997 as part of a scheme for the landless poor. The petitioner is eking his livelihood by doing cultivation. Subsequently, the land was officially transferred to Velimala Revenue Village, Sangareddy District, via proceedings No.D1/1729/2018, dated 03.09.2019.

4. Despite being in peaceful possession since the assignment, the petitioner’s name has not been recorded in the revenue records, and the Pattadar Passbook has not been issued. The petitioner has repeatedly approached the Revenue Authorities, including the District Collector, RDO, and MRO, with representations to secure the passbook, but no action has been taken. The Petitioner also approached the Telangana State Commission for Scheduled Castes and Scheduled Tribes, which led to internal communications between the Rangareddy and Sangareddy Collectors. The Sangareddy District Collector assured issuance of the Pattadar Passbook after verification. However, despite verification and assurances, the authorities have failed to take proper action, even though the land is presently recorded in the name of respondent No. 5.

Respondent No.4 issued a notice for a hearing on 18.12.2025, where the unofficial respondent No. 5 clarified in writing that he had surrendered Acs.3-12 gts of Sy.No.377 in 1990 and had no claim over it. This confirms that the petitioner is entitled to have the land transferred to his name. Despite this, the Revenue Authorities have not updated the records. The Petitioner has depended on agriculture and dairy farming on this land for livelihood, supported by family members. Official respondents and other Revenue officials have visited the land and promised to issue the Pattadar Passbook but have not fulfilled the promise, while other individuals in similar circumstances have received their passbooks.
