ORDER:

This Criminal Petition is filed by the petitioners-accused Nos.2 to 4 seeking to quash the proceedings against them in C.C.No.1111 of 2025 on the file of learned VII Additional Metropolitan Magistrate, Cyberabad at Hayathnagar, registered for the offences under Sections 420 and 417 read with 34 I.P.C.

and Sections 66C and 66D of the Information Technology Act.

2. Heard Sri D. Suresh Kumar, learned counsel for the petitioners and Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for respondent No.1-State.

3. The case of the prosecution is that the petitioners along with accused No.1 have cheated respondent No.2-de facto complainant by using fake social media IDs and took an amount of Rs.4,50,00,000/- from the de facto complainant, his friends and family members.

Learned counsel for the petitioners submitted that the petitioners are facing false allegations; that they never cheated any one, much less the respondent No.2-de facto complainant; that the prosecution also could not collect any evidence during the course of investigation; and that in the absence of any material on record, no offence can be proved against the petitioners herein. He further submitted that the names of the petitioners are not disclosed even during the course of investigation. Thus, continuation of proceedings against the petitioners would be an abuse of process of law. He further submitted that the petitioners herein are Doctors, who enjoy good reputation in the Society, and that the alleged transactions are only between accused No.1 and the de facto complainant. He, therefore, prayed to quash the proceedings in the present C.C.

Learned Additional Public Prosecutor has submitted that there are specific allegations against the petitioners herein showing their involvement in the alleged offences that they have cheated the de facto complainant by using fake social media IDs and have received crores of amount from the de facto complainant. He, therefore, prayed to dismiss the Criminal Petition.

7. It is alleged that the petitioners herein have cheated the respondent No.2-de facto complainant by using other names and fake social media IDs, namely Richa Reddy Amdelly and Preethi Reddy. It is alleged that the petitioners along with accused No.1 in a pre-planned manner and with malicious intention resorted to impersonation, stealing the identity of one Ammu @ Preeti Reddy to gain unlawfully, and indulged in close relationship with the de facto complainant (LW.1) and through their acts, they have received an amount of Rs.4,50,00,000/- from the de facto complainant, his friends and family members. The recitals of the charge sheet point out the said allegations.

8. The contention of the petitioners’ counsel is that the contents of the complaint and even the investigation of the police could not reveal any material against the petitioners herein. However, a perusal of the Case Diary point out specific allegations against the petitioners herein. It is alleged that the de facto complainant has believed the words of accused No.1 and transferred the amount to her, who pretended to be one Ammu @ Preeti Reddy. It is further alleged that believing the words of accused No.1, the de facto complainant has transferred Rs.5,00,000/- for medical expenses, Rs.4,00,000/- per personal needs, Rs.6,00,000/- for the poultry farm of her father, who is petitioner No.1 herein, Rs.5,00,000/- to her brother, who is petitioner No.2 herein, for construction of a theatre, so on and so forth, totalling to an amount of Rs.4,50,00,000/- to different account numbers.
