ORDER
This writ petition is filed seeking the following relief:
“to issue an order or direction more particularly one in
the nature of writ of mandamus or any other appropriate
writ declaring the action of the respondent authorities in
not issuing E-Pattadar pass books cum title books in
favour of the petitioner in respect of Sy.No.477B
admeasuring Acs.0.01gts. Considering the application
submitted by the petitioner dated 25.03.2023 online
Prajavani Registration No.RJ034/E/2023/00001, dated
13.06.2023, Dharani portal UL230005307 is nothing but
arbitrary, illegal, null and void and violative of principles
of natural justice and also against the provisions of the
Telangana Rights in Land and Pattadar Passbooks Act,
2020. Consequently, direct the Respondent authorities to
issue New E-Pattadar Passbooks cum title books in favour
of the petitioner in regarding with his land in Sy.No.447/B

admesuring Ac.0.01 gts situated at Siricilla village, Sircilla
Mandal Rajnna Siriclla District”
2. Learned counsel for the petitioner submits that the petitioner’s
father was issued Form 13-A under Section 5-A(2) read with Rule
22(5)(i) in respect of land bearing Survey No.531/C admeasuring
Acs.0.06 guntas and Survey No. 477/B admeasuring Acs.0.02 guntas.
The said proceedings were issued in relation to a sale transaction dated
16.08.1971. It is further submitted that the petitioner has been making
consistent efforts to have the said land mutated in his favour by
submitting representations to Respondent No.4. However, no action
has been taken by Respondent No.4. Aggrieved thereby, the petitioner
filed an application under Prajavani, bearing Registration No.
RJ034/E/2023/00001 dated 13.06.2023, which was duly
acknowledged.
2.1. Despite the same, the petitioner’s request for issuance of
Pattadar Pass Books in respect of land bearing Survey No. 447/B
admeasuring Acs.0.01 guntas under Khata No. 423, as well as the
application submitted through the Dharani Portal vide Application No.
UL2300005307, remains unattended. The status of the said application
is shown as “In Progress”, but no further action has been taken till

date. Aggrieved thereby, this writ petition is filed and he would seek
to pass appropriate orders.
3. Learned Assistant Government Pleader for Revenue on the
other hand would submit that name of Smt. Kasarpu Bala Laxmi is
recorded as pattadar for Acs.0.02 guntas from the year 2014-15 and
said land is already used for non agricultural purposes for house-site
plots and the property is no longer agricultural property. Hence, the
case of the petitioner does not deserve any consideration and hence,
would seek to dismiss this writ petition.
4. Having heard learned counsel for the petitioner and learned
Assistant Government Pleader for Revenue and upon perusal of the
material placed on record, this court is seized of the fact that the status
of petitioners application in Dharani Portal is under progress in respect
of land to an extent of Acs.0.01 guntas out of Survey No.477/B and
his prajavani application has already been acknowledged vide
RJ034/E/2023/00001.
5. In such circumstances, without going into the merits and
demerits of the case, this Court deems it appropriate to direct
respondent No.4 to examine the case of the petitioner and pass
appropriate orders, by issuing notice to all the concerned and by

affording sufficient opportunity of hearing, as expeditiously as
possible and communicate the same to the petitioner.
6. Accordingly, this Writ Petition is disposed of. There shall be no
order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
