This Criminal Petition has been filed seeking to quash the

proceedings in STC No.465 of 2021 on the file of learned Principal

Junior Civil Judge-Cum-Judicial First Class Magistrate, Gajwel,

wherein, the petitioner was arrayed as sole accused, for the offences

punishable under Sections 323 and 504 of the Indian Penal Code, 1860.

2. Heard Mr.M.Amarnath, learned counsel for the petitioner and

Mr.M.Ramachandra Reddy, learned Additional Public Prosecutor for

respondent No.1.

3. Though the criminal petition was filed seeking to quash the

proceedings in STC No.465 of 2021, learned counsel for the petitioner

requested this Court to dispense with the presence of the petitioner

before the trial Court on the ground that the petitioner is aged about 65

years and he is suffering with old age ailments. He further submitted

that the trial Court may be directed to expedite the proceedings by fixing

a time limit.

4. Learned Additional Public Prosecutor has not opposed the

submissions made by learned counsel for the petitioner.

5. Taking into consideration of the peculiar facts and circumstances

of the case, especially the fact that the petitioner and respondent No.2/

de facto complainant are none other than the son and mother, the

presence of the petitioner/accused in STC No.465 of 2021 on the file of

learned Principal Junior Civil Judge-Cum-Judicial First Class

Magistrate, Gajwel, is dispensed with, subject to the condition that he

shall be represented through his counsel on each and every date of

hearing. If the presence of the petitioner is required, he shall appear

before the trial Court. In case of his non-appearance on the specific date

fixed by the trial Court for his appearance, the trial Court is entitled to

proceed with the matter, in accordance with law. It is made clear that

the parties in lis shall cooperate with the trial Court for disposal of STC

No.465 of 2021 without seeking undue adjournments.

6. Accordingly, the Criminal Petition is disposed of.

Miscellaneous applications, pending if any, shall stand closed.
