ORDER:

This Writ Petition is filed with the following relief:

“…to issue a writ, order or direction, more

particularly one in the nature of a mandamus

declaring a. the inaction of the 1st to 5th

respondents in not providing police protection to

the petitioners in respect of land admeasuring

Ac 8.27 Gts. out of the total extent consisting of

Ac 2.20 gts in Sy No 374/E, Ac 1.33 Gts in Sy

No 374/M, Ac 2.20 Gts in Sy No. 374/EE and Ac

2.20 Gts in Sy No. 374/M in Bommraspet

village, Shamirpet Mandal, Medchal Malkajgiri

District for the purpose of enforcement of the

interim order of injunction dated 7.3.2019

passed in I.A. No. 344 of 2019 in OS No. 95 of

2019 on the file of the Learned Senior Civil

Judge, Medchal Rangareddy District as extended

from time to time despite repeated requests

made by the petitioners and b. the action of the

2nd to 5th respondents in interfering and

creating hindrances in the peaceful possession

and enjoyment by the Petitioners of the

aforesaid property while at the same time

allowing the 6th Respondent to enter upon the

Subject Property and install CC TV cameras and

the further action of the 5th Respondent in

seizing the JCB machines being used by the

Petitioners on the Subject Property for levelling

the land as being illegal, arbitrary,

unconstitutional, in violation of Articles 14, 19

and 21 of the Constitution of India and in

violation of the order dated 12.06.2019 passed

by this Honourable Court in W.P. No. 5476 of

2019, and c. Consequently, to restrain the 1st to

5th Respondents from creating hindrances to

the peaceful possession of the above property

by the PetitiOners and to provide necessary

police protection to the Petitioners in respect of

the aforesaid property for enforcement of the

interim order of injunction dated 7.3.2019 in

I.A. No. 344 of 2019 in OS No. 95 of 2019 on

the file of the Learned Senior Civil Judge,

Medchal Rangareddy District as extended from

time to time and forthwith return the illegally

seized JCB tractors to the Petitioner along with

the compensation for the costs and loss incurred

to the seizure and pass...”

2. Heard Mr. B.Shiva Teja, learned counsel appearing for Sri

Sriram Polali, learned counsel for the petitioners and Sri

D.Pradeept, learned Assistant Government Pleader for Home

appearing for respondent Nos.1 to 5.

3. Learned counsel for the petitioners submits that, during

the pendency of this petition, the petitioners have sold the land

mentioned in the petition. As such, they no longer have any

subsisting rights over the said property. Having regard to the

submissions made, and in view of the fact that the cause raised

by the petitioners was as persons interested, it is now

apparent, in light of the subsequent developments reported by

the petitioners, that the contest raised by them has become

infructuous.

4. Accordingly, this Writ Petition is dismissed as infructuous.

There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
