ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner, seeking the following relief:

“For the reasons stated in the accompanying affidavit, it is prayed that this Hon’ble Court may be pleased to issue writ more particularly on the nature of writ of mandamus to declare the action of the respondent No.2 and 3 in not issuing pattadar passbook to the petitioner and in not mutating the name of the petitioner in the revenue records with respect to agriculture lands admeasuring Ac.1-10 Gts situated in Sy.No.203/A/2 and Ac.1-07 Gts in Sy.No.241/B at Divitipalli Village, Wardhannapet Mandal, Warangal District as illegal, arbitrary and violative of Article 14, 21 and 300-A of Constitution of India and consequently direct the respondent No.2 and 3 to issue Pattadar passbook to the petitioner and mutate the name of the petitioner in the revenue records with respect to agriculture lands admeasuring Ac.1-10 Gts situated in Sy.No.203/A/2 and Ac.1-07 Gts in Sy.No.241/B at Divitipalli Village, Wardhannapet Mandal, Warangal District and to pass such other or further order as are deemed fit and proper in the circumstances of the case.”

It is stated that the petitioner’s father was the pattadar and owner of agricultural lands admeasuring to an extent of Acs. 1.10 guntas in Survey No.203/A2 and Acs. 1.07 guntas in Survey No.241/B, situated at Divitipalli Village, Wardhannapet Mandal, Warangal District (for short, ‘the subject lands’). Upon the demise of the petitioner’s father on 15.04.2006, petitioner’s mother’s name was mutated in the revenue records and she was issued pattadar passbook vide Patta No.110. Petitioner’s mother expired on 01.02.2024. It is further stated that the petitioner and his siblings being the successors of the estate left by the deceased father and mother, an affidavit dated 08.01.2025 has been executed by the siblings of the petitioner on stamp paper indicating that they have no objection to mutate/transfer the subject lands in the name of the petitioner by way of succession. The petitioner submitted an online application vide Application No.2400772578 dated 10.12.2024 on Dharani Portal seeking issuance of the pattadar passbook and consequential mutation of his name in the revenue records.

Learned counsel for the petitioner vehemently contended that as per Section 6 of the Telangana Record of Rights in Land and Pattadar Passbooks Act, 2020 (for short, ‘the ROR Act, 2020’), the Tahsildar is conferred with the power to grant succession and survivorship and inheritance seeking to effect change in record of rights after arriving at consensus among all the legal heirs on the manner of division of the land among themselves. When such an application is being made, the Tahsildar can amend the record of rights by duly incorporating the names of the petitioner and his siblings in terms of the family consensus settlement deed entered between the family members. Learned counsel for the petitioner further contended that in terms of the said provisions, the petitioner made an online application vide Application No.2400772578 dated 10.12.2024 for succession and mutation of his name in the revenue records.

Learned Government Pleader appearing for the respondents has not disputed the fact that the petitioner has made an online application and powers have been conferred on the Tahsildar in terms of Section 6 of the ROR Act, 2020. 5.
