ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner, seeking the following relief:
“For the reasons stated in the accompanying affidavit the petitioner herein prays that this Hon’ble court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring action of respondents in issuing final allotment orders in-spite of pending enquiry in accordance to 2nd respondent letter vide Lr. No. H2/1281/2024 dated 28-12-2024, whereby directing 3rd respondent to conduct an enquiry and submit factual report with regard to allegations received over inclusion of respondents no. 6 to 11 and also in-spite of our specific objections and request to cancel said allotment as illegal, arbitrary and against to principles of natural justice and also violation of guidelines enumerated under GO Ms. No. 10 Housing (RH & C. A1) Department dated 15-10-2015 and consequently set-aside allotment vide Procgs. No. H1/1281/2024 dated 16-10-2024 issued by 2nd respondent with regard to respondents no. 6 to 11 herein and to pass such other order or orders in the interest of justice.”
2. It is stated that the petitioners are the residents of L.B.Nagar Slum situated in T.S.No.12, Block-E, Ward No.75 in Survey No.227 of Bakaram Village, Musheerabad Mandal, Hyderabad District. It is stated that the petitioners are residing in the said locality from the decades in small tin shed rooms and katcha houses and they are also having ration cards and all the families of the petitioners are Below Poverty Line (for short. ‘BPL’). It is further stated that the Government of Telangana has issued guidelines under G.O.Ms.No.10 Housing (RH&C.A1) Department dated 15.10.2015 for evaluation a policy for allotment of double bed room houses to the weaker sections and BPL families. It is further stated that as per the said policy of the Government, the beneficiary families should be a BPL family having valid Food Security Card and houses will be sanctioned in the name of the house maker of the family besides other conditions. It is further stated that in terms of the above said G.O., the official respondents have vacated their huts/dwelling units and handed over the land to enable the Government to construct the double bed room houses in terms of the policy laid down in G.O.Ms.No.10 dated 15.10.2015. It is further stated that to implement the scheme enunciated under the said G.O., the official respondents have conducted Socio-Economic Survey and the petitioners and others were identified as beneficiaries for allotment of the houses. It is further stated that the Tahsildar has identified ineligible persons as beneficiaries for allotment of double bed room houses. The petitioners have submitted a complaint/representation on the file of the 2nd respondent-District Collector. The 2nd respondent-District Collector while acting on the said representation directed the 3rd respondent-Revenue Divisional Officer, Secunderabad Division vide Letter No.H2/1281/2024 dated 28.12.2024 to submit a detailed report for taking further necessary action for allotment of double bed room houses.

Learned counsel for the petitioners submitted that respondent Nos.2 to 4 even without conducting any enquiry in terms of the directions issued to the 3rd respondent in Letter No.H2/1281/2024 dated 28.12.2024, at the instance of the political hierarchy in hasty manner have submitted a list of persons interested and acting on the said list furnished by the political hierarchy, the District Collector is taking steps to allot the houses to ineligible persons.
